Gan Eng Gor... Another corpse-snatching by Police & Islamic authorities

JANUARY 19: It was reported by French wire agency AFP, quoting The Star, that Malaysian police have seized the body of Gan Eng Gor, an ethnic Chinese man, in the latest dispute between Islamic authorities and family members over a disputed conversion. Quote:

The dispute comes just days (Jan 18, 2008) after a court ordered a Christian woman's body be returned to her family after Islamic authorities admitted they were wrong in claiming she had converted.

The cases have fed accusations over the growing "Islamisation" of Malaysia, where the population is dominated by Muslim Malays living alongside ethnic Chinese and Indian communities.

The eldest son of the deceased, who died on Sunday aged 74, said his father became a Muslim last July, but his other children reject the claim and insist their father was a Buddhist.

Police reportedly took Gan's body from a funeral parlour outside Kuala Lumpur after his eldest son, 47, who became a Islam several years ago and renamed Abdul Rahman Gan Abdullah, lodged a report claiming his father had converted and taken a Muslim name.

Even Eng Gor’s widow, Chua Chun, 65, who had been looking after her bedridden husband over the past two years and the couple’s seven other children, denied this.

A legal tussle, with the Syariah Court at the core, ensued.

JANUARY 20: The Syariah Court in Seremban deferred the hearing to determine the religious status Gan Eng Gor to allow his Buddhist family -- to appoint a Syariah counsel.

According to The Star, Registrar Abdul Razak Mat Nayan told the dead man’s children that they would also have to submit the names of those who would testify during the hearing as part of the syariah court process.

JANUARY 21: On behalf of the family, Gan Eng Gor’s sixth child, Gan Hock Lim, 40, a supervisor living in Klang, filed a case at the High Court in Seremban, challenging the deceased's conversion to Islam.

The family was represented by lawyers recommended by the MCA.

JANUARY 24: Seremban Syariah Court judge Mohd Nadzri Abdul Rahman in his ex-parte judgment said Gan Eng Gor, whose Muslim name was Amir Gan Abdullah, was a Muslim based on the testimony by officers from the council and his oldest child Abdul Rahman Gan Abdullah.

The remains of the 74-year-old man, whose widow and seven children had no knowledge of his conversion to Islam, was yesterday released to the state Islamic religious council for burial.

Eng Gor’s widow, Chua Chun, and the couple’s seven other children were not present in court yesterday.

Gan's next of kin -- two of whom are bloggers -- contacted me last night.


I was told that the deceased's family will be going ahead with civil suit against the eldest son for forgery charges as the father, who was paralysed and couldn't talk due to a stroke, was deemed to be invalid.

I was made to understand that evidence of discrepancy on all the documents will be tendered. There would be argument that Gan's supposed conversion was concealed from the rest of the family until his death last Sunday.

The eldest son had apparently lodged a police report, saying that the deceased was a Muslim, and wanted to claim the body, despite his mother having kowtow-ed appealing for compassion.

The family said they "lost" the case in Syariah court as their application for an injunction to stop the Syariah court from proceeding came in way too late.

It is really heartbreaking to read this. Just for how long are they going to continue with this kind of insult? How could the police blatantly help to propagate this kind of injustice?

The government has messed up big time with a "one country, two (courts) system".

Coupled with overzealous officials from the bureaucracy to the courts, justice is not served. My question is how does a bed-ridden man get converted ? Don't the islamic official need to be present? or is it just filing some papers purported to be signed by the father? If that is the case, any of us can be converted without our knowledge ! Somebody please enlightened me what exactly is the procedure to officially convert to Islam.

sad but there's more to come. if Gan Eng Gor had a will, it would now be invalid as the estate has to be divided in accordance to Islamic law. I hope common sense prevails.

This type of son, really a waste of money and effort in raising. I pity the mom, to have such a horrible, ungrateful, traitorous son. What goes around comes around, this so-called "religiously minded" eldest son will get his just rewards sooner or later, for dishonouring his parents.

It is indeed sad to come across such a case like yours. It breaks my heart each time whenever I read it in the papers. It is indeed very unfortunate that the grieved family members of the deceased could not even have a peaceful funeral.

I have nothing against conversion to Islam. However, many of us are unaware that a non-Muslim stands to inherit NOTHING when their loved ones, be it spouse or parents dies as a Muslim.

According to the Quran, the distribution law of a deceased’s assets or better known as “hukum Faraid’ clearly states that a non-Muslim cannot stand to inherit anything from a Muslim convert upon his/her passing.

Such situation did occur about 5 years ago in Malacca when a Chinese Fireman converted to Islam without his family knowledge. When the said fireman passed away, his family stood to inherit nothing, ie not even the house in which his family was living in and monies at the bank. All assets/ properties of the deceased fireman went to the Islamic trust or Baitulmal. However, after much pleading, the Malacca CM odered that half of the properties kept at Baitulmal be released to the family members.

In short, the nightmare is far from over.

The deceased was bed ridden at the time of the so called conversion??? Was he lucid enough to know what he was doing?

The suspicious ciecumstances here is that the eldest son could have taken the father for a ride and done what ever he wanted with him.

The point is now that there is a son who qualifies under muslil law to inherit all of his estate, this nullifies any will he may have left behind and everything goes to the eldest son. Very convenient!

Does the state has nothing better to do than pay these "holier than thou" to snatch bodies?

Can we leave personal beliefs to personal belief?

wtf the state got to do with what we believe?

Anyway, anyone think Allah/God will give two thumbs up for all thats happening in the Islamic countries around the world?

The cynic in me now see ALL the 'inheritance' goes to eldest (muslim) son since the non muslim siblings can't inherit dead 'muslim' dad's assets.

it just wont stop and it just happens too often for us to 'swallows' it. we are just so helpless, we are 'equal', we have 'rights' but when a case this sensitive appeared, no one...except the family members came to help.

where are u OKT? isnt it time for you to act instead of concentrating on winning in the next GE? what is the difference between pakistan and afghanistan? what is the difference between the treatment of female in that country and non-muslim here? virtually we have 'rights' but in reality, we dont.

If, he really really really did converted, I'd blame the deceased for the mess he created by hiding his conversion.

1)Under Syariah law a none muslim is not entitled to inherit anything.

2) Ngiam's case is ample evidence that the conduct of certain people who video records innocent people who put their trust in a bomoh to cure one's illness but later they were deceived to go through conversion ritual. Wonder why no police action against this bomoh and the son? In fact they should be put under ISA for causing so much distress between two religion.

3) Moorthy's family will be forever be remebered for the failure of the judicial system to dispense justice.

And one more thing, now I am really worried about children who recite some arab words which they were forced to listen during school assembly. Wonder if one day they too deemed converted. This is serious why is the governemnt not doing anything??

How are do people who are sick and dying suddenly convert? Are they in the right frame of mind.

In this case why didn't the elder son take care of the father?Is there more to this, like inheritance? Sounds fishy.

I would take some nice photo of me and my parents relishing on suckling pigs so that should someone claim that my parents are Muslims, when they die, I will then post the photos in the internet and let the Muslims know that I hope they are now happy that their burial ground are being defiled by pig lovers.

i can only weep in tears, knowing such suffering is possible in this world. my condolence to the family, but more so, i am more determined to do good in my life.

To me, religion is the most dangerous thing in the world. I dont think there is god. Ah, got you ! See, everyone, Muslims, Hindus, Buddhists, Christians, etc. will just team up and try to prove me wrong. Because of ego, people with inferiority complex will try to show to people that they are not "weak".

The Muslims are fighting for dead bodies, then the Buddhists and Hindus are ensuring their children keep up with the Buddhist and Hindu faith. These things will not happen if people just "don't care".

If these Muslims like "to steal" dead bodies, thank them for the free burial, see how many times they can do that before they start charging a fee. Religion only exist when people think they need it, which I think is unnecessary.

A very dangerous precedent. Any learned muslim religious person will tell you that it was most probably not possible for someone who has stroke, unable to speak to have met the conditions to profess his muslim faith.

It reminded me when I got married about 10 yrs that the registration dept had recorded my religion as muslim and I had to give a testimonial from the commissioner of oaths stating otherwise bef I can get my marriage registered at the Registrar rather than at a registered mufti.

I wonder what will happen to me when my day comes for me to meet my creator whether there will be an "invasion of body snatcher"?

i think this case is simple. it's all about the assets left by the late Mr. Gan. it's very obvious that it's impossible for him to convert to islam since he has not been able to move or talk. how can he voice out his desire to convert?

and the reason for his eldest son to claim that he has converted is also very obvious. he knows that if his father is a islam, he will get all of his father's assets. isn't the judge smart enough to see this? or are they just trying to have more people to die as a muslim?

i'm not against converting into islam in any way, but it has to be something that you are doing it out of your heart, and not something that your son do for you when u are unconcious. i believe Allah/God would not want someone to be forced to believe in them as well.

so mr judge for this case, be a good judge! show that malaysian judges still have integrity. make the right decision!!!

I'm quite sure it was not, as he encouraged religious tolerance.

Corpse snatching is another deviation of the teachings of the founder of Islam.
