Attempted murder: Who are the 31?
Thirty-one persons who participated in the HINDRAF rally have been charged with attempted murder of a policeman during the debacle at the Batu Caves Temple.
The policeman survived with his wounds stitched. The 31 are still detained pending trial, bail denied.
December 7, human rights lawyer Malik Imtiaz Sarwar wrote in his blog, DISQUIET, urging the authorities to Free The 31.
What's the profile of the 31 accused of attempted murder?
Latest information revealed they are technicians, lorry drivers, students, odd-job workers, a dialysis-dependent kidney patient, and one with a hole in the heart.
Malaysiakini compiled the list of the 31 individuals - some of whom are Hindraf members while others were -- like Imtiaz said -- just at the wrong place at the wrong time.
1. SS Ganishen, 39, lorry driver.
2. K Raju, 42, driver.He is hard of hearing on one side.
3. R Sakthivel, 34, technician.
In court, he told reporters that he left his bike when he passed by the Batu Caves temple to see what was happening. When he returned to his bike, the police arrested him.
4. K Ganapathy, 38, lorry driver.
5. K Sukumaran, 24, foreman.
6. S Kumaran, 25, farmer.
7. B Varatharaju, 32, foreman.
8. M Kuna Sekaran, 24, machine operator.
9. V Ganeson, 40, lorry driver.
10. L Thiyagarajan, 31, sales executive.
11. S Gunaa, 21, is a farmer.He only gets salary when there is work.
12. K Thinagaranpillay, 23, manager.
13. N Balamohan, 23, part-time worker.
14. K Gopinath, 27, store keeper.
15. R Suresh, 24, runs his own business.
16. G Suman, 20, runs his own business.
17. M Buwenthiran, 24, technician.
18. M Pushparathan, 21, technician.
19. S Tail Arasu, 26, despatch boy.
20. N Ramasamy, 43, is a driver.He is also a kidney patient. He showed his dialysis card in court but this was dismissed by judge Azimah as it did necessarily prove his health condition.

22. R Pushpanathan,19, despatch boy.
23. S Mugilan Dever, 20, student.
24. G Thinesh Kumar, 19, foreman.
25. T Kunalan, 28, machine operator.
26. S Sures, 18, car-tinter.He has a hole in the heart.

28. N Markandan, 54, odd-job worker.
29. K Raghu, 39, technician.
30. A Rayar, 30, His occupation is unknown.He had an engagement ceremony planned on Dec 7 that had to be cancelled.
31. S Ravi, 33, lorry driver.
At the time I blogged this, the Court's Dec 6 decision still stands, and I was made to understand that these 31 people will remain incarcerated in Sungai Buloh prison for over a month until their trial begins on Jan 14 next year.
I say, free them. FREE THE 31.

If the 31 wanted to murder the policeman, he would be dead in a second.
Just think, 31 chances at the deed and he's still walking? Or, first, then second, then third, then... and they all fail?
So, if the charge now looks ridiculous, then each would not be guilty of that charge. In this case, that means ALL are not guilty of that charge.
And if you look at their occupations, you no longer wonder why so many thousands came out to walk their grief.
They have already suffered enough in their lives.
Free them. Reward the policeman for doing his duty. Then call for another royal commission, and this time make it monarchic, to look into these events past, and what ails....Malaysia.

Why these 31? Becasues it is easier to coax them to come out and say how misled they were in being part of Hindraf? That they got conned into supporting Hindraf and so on? Is that why they have only taken in these people? Or are these 31 supposed to represent all the Indians in Malaysia?
Then of course one of their complaints would be proven correct. They are ALL marginalised and that is why they all hold marginalised jobs!!
Or is it that these people are expandable so kick them around. Whereas those under ISA would be a little more difficult to prove anything against them by way of law. So ISA is used.
This is the work of a chicken shit leadership in government unfortunately. (You see I am not critical of the government. Only its leadership!)

I think our government is in the position of embarrassment. They can't just free the 31 and let the Rakyat "win". The more we "demand" to free 31, the harder our government will do so.
So instead of "demanding", we can use "soft" method. This way, our government will show their "pity" and "mercy", and thus they will "pardon" these 31 and declare "win" for the government and served a "lesson" to all Rakyat not to provoke the government!
Hey, they are Big Bully OK? They already told you "you voted us"! Not happy with their way? Don't vote them lah! Well, they dare to say knowing that you never vote them out for fear of the imagination riot that they plant into your mind!
So guy, I think if we push and push and push, one day the government may just sentence the 31 of them into life time jail or dead sentence (save cost to cook food for them). There is nothing financially they can "squeeze" out of these 31 except to either end their life or work in prison for free labor.
Gosh, how pessimistic I am today!
But rest assure our government is doing something to case close properly without losing "maruah".

Other than that, I think it is a heinous violation of human rights to stop those with ailments to receive medical treatment that they require as well as arresting those who were simply there at the wrong time.
Other than those individuals, I'm sorry to say that if they were in direct physical contact with the police officer, and this can be proven, then I'll agree with the judge on the ruling of no bail.
Was there such evidence presented in the hearing to determine the bail amount?

The 31 are very likely to escape the “attempted murder” charge and face some lesser charge as PM has issued a “directive” to the AG and the “credit” goes to the good offices of Samy Vellu & MIC. Come Monday they would be out on bail after all they are mere small insignificant fries now that the leaders are safely ISA netted. This goodwill gesture might ameliorate the inconvenience they faced but the hurt, mental or emotional suffering would forever be etched in their minds.
Abdullah also countered Karpal Singh’s contention that the ISA detention orders were defective by saying
“The law allows the minister to act under Section 1 of the Act (ISA) after he is satisfied with the investigations carried out".
And lastly, he assures the public that there are no Rumoured Clashes in Kg Baru & Puchong come Sunday 16 Dec 07.

Poor lads. Just as Iraqis were made to suffer for the 9/11 attack which were done by arab saudi citizens, these 31 guys are held under similar circumstances, held up as an example to other indians, not to rock the boat of UMNO apartheid leadership.
If not for Hindraf, would badawi be meeting the indian reps and NGO's recently?

Yes. Correct. They have all the opportunity to defend themselves in court. I though that what all of us want. To bring this issue to court.
However, fight like a man. Don't tell the world now that you have health problem, fever, you work as a driver, etc. etc.

how about the malays who were shoot by the police during batu buruk rally. arent the KERAjaan going to drop charges against them or the KERAjaan is afraid losing indian vote or because the malays is mudah lupa.
JEFF OOI says: I was hauled for Police questioning as I spoke up in Al-Jazeera for these two victims of live bullets during the Batu Buruk Incident. The two victims are now charged, bail denied. Again, I had brought this up with Suhakam several days ago. Hope we see reprieve for the two people, too.
