Maruah Nazri & seppuku?
The Shock-A-Lingam Tape exposed not only power brokers in the Judiciary, it strip-teased the public how Abdullah Administration held law in regards.
Sunday, Minister in the Prime Minister's Department Mohamad Nazri Abdul Aziz said witness and whistle-blowers in the Lingam Tape can be given a new identity or undergo surgery to be given a new face under the Witness Protection Act.
Nazri claimed that witness protection is given even in police and ACA cases and not only for Royal Commission cases only.
But what Witness Protection Act this Nazri was talking about?
The following day, October 8, Bar Council said there is no such legislation.
Council president, Ambiga Sreenevasan, said the council had never heard of such an Act on witness protection and even if there is one, it did not know its scope.
"Although Section 53 of the Anti-Corruption Act 1997 provides some form of protection, it is not to the extent mentioned by the minister," she said.
Meanwhile, former United Nations special rapporteur on the independence of judges and lawyers Param Cumaraswamy said in a statement that Parliament had only passed the Evidence of Child Witness Act, making provisions relating to the giving of evidence by child witnesses this year.
"I hope Nazri is not confused with the Act. As a de facto minister for law, he should exercise caution and check his facts before making public statements. Incorrect statements such as this could embarrass the government," he was quoted as saying in theSun.
Even a legal novice like Parti Keadilan Rakyat president Dr Wan Azizah Wan Ismail had commented that she was mystified when Nazri made the statement as the legal division in parliament has confirmed that no such Bill had been tabled for a first reading in the lower house.
“The only bill which was tabled, debated and passed by the Lower House two sessions ago was the Evidence of Child Witness Bill 2007,” she said in a statement October 8.
The Nazri U-Turn
Yesterday, October 9, Nazri made a turn-around and admitted that he had had a big boot in his mouth.
He submitted that a Witness Protection Act did not exist in Malaysia.
However, he shifted the blame for the snafu to his aide. He said he had got his press secretary to inform the press to correct his statement on Sunday but it was not done.
"The government is looking to enact a law to protect whistle-blowers, there is a need for such a law," he said in a phone interview with theSun.
Nazri told theSun that when he spoke to reporters on Sunday, he was referring to all available Acts in the country that offered some protection to witnesses, like the Anti-Corruption Act, Criminal Procedure Code, Evidence of Child Witness Act and Anti-Trafficking In Persons Act.
He, however, stopped talking about the plastic surgery that he profferred to protect the whistle-blowers under new identity.
'Cakap tak serupa bikin'
It is pertinent to recap that the Abdullah Administration, which promised to whack corruption big time, had never been serious in strengthening laws that complements graft-fighting.
In 2002, former Minister in the Prime Minister’s Department Dr Rais Yatim had said that a witness protection scheme would be introduced to assist Malaysia’s effort to combat terrorism.
In August this year, Inspector-General of Police Musa Hassan also called for a Witness Protection Act to shield those who help in police investigations or testify in criminal cases.
Nothing happened.
If only Nazri had maruah in his self, Malaysia will be spared the agony to suffering fools. But I don't think he understood what was written on harakiri as a means to seek redemption for high office failures in Japan.
I hope he didn't mistake seppuku for hala-kanan.

If the witness or source were to believe what Nazri promised of a change of identity and gets protection for coming out when there is no witness protection, he/she might end up with the plastic surgery that the poor Mongolian women had. The audacity of Nazri to even say blatantly, "if you cannot even trust the govt..."
Last time I trusted the govt and voted for the BN because AAB said that he was taking firm action against corruption. Look where we are now at the end of his term? More corruption that ever. And, he wants another term?

Gabungan Menuntut Pilihan Raya Bersih dan Adil (BERSIH) akan menganjurkan satu perhimpunan raksasa yang dinamakan perhimpunan rakyat pada Sabtu 10 November ini di Dataran Merdeka.
Dalam satu pengumuman yang dibuat pada sidang media hari ini, BERSIH dijangka akan mengadakan perhimpunan tersebut bermula jam 3 petang.
"Perhimpunan tersebut seterusnya akan berarak ke Istana Negara bagi menyerahkan memorandum tuntutan rakyat kepada Yang di-Pertuan Agong untuk menyuarakan hasrat rakyat untuk menjalani pilihan raya yang bersih dan adil seperti yang terkandung di dalam tuntutan BERSIH sebelum ini," ujar wakil Jawatankuasa Bersih di Pejabat Agung PAS, Jalan Raja Laut tengahari tadi.
Menurut Jawatankuasa BERSIH, Sivarasa Rasiah, ia juga sebagai satu ketetapan yang telah diambil oleh mereka yang menjangkakan bahawa pilihan raya umum ke-12 akan diadakan seawal November.
"Kami membuat telahan tersebut berdasarkan situasi Umno-BN yang kini berada keadaan terdesak, setelah melalui dua insiden yang menekan mereka iaitu peristiwa berdarah di Batu Buruk serta pendedahan video klip rasuah peguam dan hakim negara," jelasnya.
Perdana Menteri, Dato' Seri Abdullah Ahmad Badawi ujarnya mungkin akan membuat pengumuman tarikh PRU 12 lebih awal untuk mengeluarkan diri mereka daripada tekanan-tekanan tersebut sepertimana yang dibuat oleh PM sebelumnya pada PRU 1999.
"Ia adalah suatu jangkaan kritikal dibuat BERSIH berbeza dengan beberapa tekaan yang dibuat oleh beberapa parti politik sebelum ini," ujar AJK PAS Pusat, Dr Dzulkefly Ahmad pula,
Tindakan mengadakan perhimpunan tersebut adalah rentetan daripada resolusi Konvensyen Rakyat beberapa bulan yang lalu.
Koordinator Badan Penggerak Demokrasi Rakyat, Anuar Tahir berkata tarikh pilihan raya bukan suatu fokus yang utama bagi BERSIH sebaliknya tuntutan reformasi rakyat terhadap perjalanan pilihan raya perlu terus dihidupkan.
"Kerana ia mungkin akan mengundang kecurangan dalam PRU 12 sebagaimana yang berlaku dalam PRU 2004 yang lalu," jelasnya.
Penganjur juga ujarnya sedang berusaha menyelesaikan urusan mendapatkan permit untuk mengadakan perhimpunan tersebut, serta telah menggerakkan ahli-ahli parti atau pertubuhan yang bergabung dalam gabungan tersebut bagi menjayakannya.
"Kami juga telah bersiap sedia dengan sebarang kemungkinan dan risiko yang bakal berlaku nanti," tambah Sivarasa.
Sementara itu, dalam sidang media yang sama BERSIH turut memaklumkan bahawa mereka akan menghantar surat kepada Suruhanjaya Hak Asasi Manusia (Suhakam) berhubung isu tragedi berdarah di Batu Buruk pada 8 September lalu.
"Setelah mengadakan mesyuarat hari ini, kami membuat keputusan untuk menghantar surat kepada Suhakam mengenai permintaan kami agar diadakan satu siasatan menyeluruh terhadap tragedi tersebut memandangkan Pesuruhjaya Suhakam, Dato' Siva Subramaniam telah membawanya ke mesyuarat mereka semalam," ujarnya.
Bersih berharap akan mendapat keputusan yang positif daripada hasil mesyuarat tersebut, seterusnya membawa kepada tindakan bersepadu supaya perkara tersebut tidak akan berulang.
"Malangnya, media arus perdana sengaja memainkan taktik 'kewartawanan jahat' yang sentiasa diulang tayangan menyebabkan persepsi buruk rakyat kepada Bersih dan parti pembangkang," tambah Dr Dzulkefly.
Bersih menyatakan kekesalan dan menyelar tindakan parti pemerintah yang menggunakan media arus perdana sebagai jentera menyebarkan propaganda jahat serta kempen untuk merosakkan imej parti-parti pembangkang.

What harm or effort is it for the Government to set up a legally constituted Royal Commission, set up under an Act of Parliament, for such a MATTER OF GRAVE IMPORTANCE to the Judiciary, the future of the Legal Profession, and the Malaysian Public.
A Royal Commission is a legal entity and itself has immunity and can confer immunity, summon witnesses, direct investigations, determine authenticity, and do the whole spectrum of work for this very important matter facing the nation today.
The question of responsibility of the source to volunteer information to ACA or Panel does not arise when that person fears for his safety. Only a Royal Commission would provide him that protection and assurance to provide information, at least for the time being, until a Witness Protection Bill is passed in parliament.

Jeff,
I believe this whole witness protection, 'new identity, new face' thing is nothing but a red herring. Please don't be diverted by the fact that it's not even provided for under the law. Commenting thus, only serves to distract from the core of the matter.
Remember - the person who filmed the clip was comfortable in the group that was present. He/she obviously had the confidence of the person speaking as this didn't really appear to be a very covert recording.
Therefore, by extraction, the film maker is presumably a person of some standing in the community, and would be unwilling to have to give up this position just to expose some wrongdoing, however major or important. Who would? What sort of identity would be given to compensate for the comfortable life already being enjoyed? Malaysia isn't that big, remember!
I believe the more appropriate response would have been to celebrate the whistleblower's actions. He/she presumably has sufficient evidence and credibility to make a charge stick, but to expect them to take an offer such as is being 'made', is not going to produce anything but a stalemate. Remember, Malaysians don't do well on hanging on to things (Citizen Nades excepted!) and we all forget too quickly when nothing exciting happens.
The whistleblower must, though, be prepared to follow through. Even if the terms of reference of the enquiry are changed to ensure that the truth is found and the 'authenticity' is proven, that person must come forward and show their face. There are plenty of Malaysians who would shout 'HERO'. The world can only be changed when people start sticking their necks out. Remember Nixon - if two reporters had not followed through, he'd have goitten away with it.
I may be naive, but I believe that if the enquiry is done properly, the person should have nothing to fear - their instant high profile as the exposer should afford far more protection than any 'witness protection' ploy.

But Nazri could have been thinking of the C4 solution that would certainly protect witnesses from being found out. Or course they got to perfect the system a little. Surely after a C4 application witnesses and whistle-blowers who ned to disappear would most certainly will.

Everytime he speaks he proves yet again just how little his brain corellates to his mouth. Or maybe what he has is really a very limited brain capacity....yeah that explains it!Pity his kids....they've got his DNA. A law minister who does not know law (and looks, acts and speaks like a thug to boot!).....no wonder the state of governance of this country is backsliding into a cesspit. Nazri, pls retake your bar exam, and throw in some social etiqquete lessons. You need it!
