"Tier 3" in human trafficking

Good news or bad news?

OK, bad news first. Malaysia, a key trading partner to the US, has been blacklisted by Washington for human trafficking in a 236-page report launched by the Secretary of State, Condoleezza Rice.

The annual "Trafficking in Persons Report" (download PDF here), compiled by the US State Department, analysed efforts in about 164 countries to combat trafficking for forced labour, prostitution, military service and other purposes.

Malaysia was placed in "Tier 3", the most pariah possible group. Malaysia was cited for "failure to show satisfactory progress" in areas such as punishing acts of trafficking, providing adequate shelters and social services to victims and protecting migrant workers from involuntary servitude.

"The Malaysian government needs to demonstrate stronger political will to tackle ... significant forced labour and sex trafficking problems," said the annual report.

Being on the blacklist means Malaysia and other countries on the list could face sanctions, including the withholding by the United States of non-humanitarian, non-trade related foreign aid, wire agency AFP said.

Countries that receive no such foreign assistance would be subject to withholding of funding for participation by government officials in educational and cultural exchange programs.

Now the good news. Malaysia is not alone. Washington’s Middle East allies Bahrain, Kuwait, Oman and Qatar; Algeria and Guinea were the other additions to the blacklist that Malaysia is in.

These countries, all of whom were on a special watch list last year, join Burma, Cuba, Iran, North Korea, Saudi Arabia, Sudan, Syria, Uzbekistan and Venezuela in the dreaded "Tier 3" list as the worst offenders of human trafficking.

In contrast, Singapore, which had been in the "Tier 1" list, was down-graded to "Tier 2" this year. It "does not fully comply with the minimum standards for the elimination of trafficking," the report said.

Last year's critical cases like Bolivia, Brazil, Indonesia, Israel, Taiwan, Peru and Jamaica, made "significant efforts" to combat the trafficking problem and have been removed from the watchlist.

In summary, Secretary Rice cited "disturbing evidence" that prosecution of human trafficking cases had leveled off across the globe.

More good news. On behalf of the Malaysian government, Foreign Minister Syed Hamid Albar has brushed off the US State Department report as one-sided and ill-informed.

So are we supposed to feel better because other countries are in the same boat with us?

Or because we always know that Big Brother USA is always biased against Malaysia?

Its not just the US fingering us. Both Australian and Dutch authorities have raised concerns that Malaysia is a major hub for human trafficking. Prostitutes, illegal workers.
Of course , Malaysia is free to counter this by demonstrating the active steps we have taken to fight this. Thats what Diplomats are paid to do.
But unfortunately many of our diplomats can barely communicate in diplomatic English...

Jeff, it seems that we are very good at pointing the flaws and shortcomings of all reports/studies that make us look bad rather than accepting the fact that we need to improve...don't you think so?

Just my view.

I agree The memorandum of understanding between malaysia and indonesia 2006 is real. It gives employers the authority to withold travel documents of domestic labours. Also the employers has legal right to withold their pay until they have finished their service. Those who has maid in their house know it very well. I think so this kind of practice is primitive and no difference to slavery. I can start to imagine myself in a foreign land with my travel documents confiscated by my employer, my first three months pay goes to the agent, and only get my pay after I finish my one year contract service. I would call that slavery. We should be more humane.

That memorandum alone probably brought us down to tier 3.

Misleading report? Is it any wonder why Malaysia is placed on Tier 3 and blacklisted by Washington? Our CID Boss Datuk Christopher Wan has on record (May 24 07, Bernama) admitted the police have “arrested 32,357 foreign women involved in vice activities in the country between 2000 April 2006” – an average of 5000+ a year and managed to rescue “344 foreign women from the clutches of unscrupulous vice operators between 2004 and 2006” – an average of 100+ a year.
A dismal and futile effort on the part of the police; their hands are tied with the Tourism Minister calling the shots. The main problem is the relentless chase for the “tourist dollars” to pander to the whims and demands of the greedy fellows in the tourism industry. The immigration department has relaxed the rule - all and sundry arrivals (assumed tourists with thick wallets) are given “one-month-visa–on-arrival” and police are now looking for 20,000 + “free lancers” china dolls & other illegal Indian & other workers who have overstayed (Malaysiakini, Apr 23 07). Over the past few months, almost on a regular weekend basis, raids have been carried out at the red light areas in Bukit Bintang and Jln Pudu and other sleazy joints and massage parlors. As usual the big fish in the big hotels are spared to protect the high class hookers getting RM2K a night.

However not all is in vain; our Minister Shahrizat in Shining Amour is coming to the rescue of the Exploited Women. The Anti-Human Trafficking Bill is given the NOD by Malaysian Cabinet; Police & Immigration Department will have more Clout to combat the Scourge of Human Trafficking. And PM Abdullah in response has stated the Bill will be sent to Parliament in the next sitting and the stiff penalty will be “twenty years” imprisonment for human trafficking. Better late than never but the “tourists” will keep on coming at least perhaps after the Visit Malaysia year 2007.

Practically everyone took the cue from PM and protested...looks like our PM is not ZZZZZZZZZZ after all. But most surprising of the pack was our Women Affairs Minister..she was also quick to shoot down the report. If she had reacted as fast as this to condemn our "bocor" MPs she would have earned my respect. Her action in this case is a cheap shot.
