Maybank rapped for pro-Bumiputra discriminatory policy

UPDATED VERSION. MCA think-tank INSAP’s economic caucus vice-chairman Dr Jeffrey Goh and the Chinese Press must be commended for raising this issue of public interest last Tuesday.

Maybank, a government-linked company (GLC), and another unnamed major bank, gave come under severe public criticism for practising pro-Bumiputra policy discriminating against their multi-racial clienteles.

The two banks have recently introduced new regulation requiring law firms to have a minimum of three partners, of which one must be Bumiputera with a minimum 50% stake in the firm, before they can do any business with the banks.

Media reports said the requirements would take effect on July 1 while the deadline for existing firms is a year after the new ruling is implemented.

Dr Goh was quoted as saying in the Chinese Press that the regulation is an insult to the legal profession and contradicted the prime minister’s calls to promote meritocracy.

The Bar Council has cried foul over the conditions set by the banks. Quote Council chairman Ambiga Sreenevasan from Bar Council website, May 6:

  • The requirement is "totally discriminatory"

  • There is no legal basis for such a condition and it’s certainly in breach of the spirit of the Federal Constitution.

  • All our lawyers should be judged on merit. That is the correct basis for selection.

  • Most of all, we are concerned that such preferences will give rise to tokenism and that it will affect the quality of the legal services provided.

Ambiga said the Bar Council had written to the banks in the last two days expressing concern and asking them to review their policies.

The Bar Council will also be following up on this matter with Bank Negara Malaysia.

Legal circles said, at the moment , there are no specific requirements for legal firms to be appointed by financial institutions. Even the Bank Negara had said there is no specific requirement for legal firms appointed by financial institutions.

Meanwhile, the Associated Chinese Chambers of Commerce and Industry of Malaysia (ACCCIM) has rapped Maybank for the discriminating policy. See Bar Council website archive here.

Yesterday, Maybank went to Press by stating that it would do the necessary review based on feedback, giving no specifics.

It might be too late. The issue was debated in the Parliament with MCA Youth chief Liow Tiong Lai urging the PM to intervene. See Oriental Daily News here as MCA's mouthpiece, The Star, has missed the story today.

UPDATES: On the contrary, deputy Finance Minister Ng Yen Yen, also from MCA, was quoted in Malaysiakini Chinese Edition as saying that the government has no power to intervene as it was an internal policy of Maybank.

According to Malaysiakini, DAP Member of Parliament for Bandar Kuching Chong Chien Jen yesterday tried to move a motion to debate the matter in the Dewan Rakyat. However, Speaker Ramli Ngah Talib rejected it it, saying that it was an internal matter of the bank.

However, Chong disagreed with the decision, saying the Speaker had taken the easy way out. Quote:

“All banks in Malaysia are subject to the directive and policies of Bank Negara. The Speaker’s decision only shows that the government condones practices that are discriminatory on a racial basis,” he alleged.

“Previously, this has been done in relation to government procurement procedures. Now it has sipped into procedures of government-linked companies,” he said.

Parliamentary Opposition Leader Lim Kit Siang was more specific in his statement to Maybank. He said in keeping with the principles of CSR (corporate social responsibility), Maybank should not speak in ambiguities but must make clear its policies and guidelines.

Kit challenged Maybank to be a model of CSR and make public the top 25 legal firms on its panel which have been given the most bank business each year for the past 10 years.

(He) urged Maybank to explain whether the 50 percent bumiputera partnership ruling will come into force on July 1, and how it will impact on both current panel lawyers and new firms.

“I call on Maybank to be a model of corporate social responsibility and make public the top 25 legal firms on its panel which have been given the most business each year for the past 10 years,” said Lim.

“This is to allow the public to judge whether the firms given the most business are the politically- connected ones rather than those (who receive work) based on meritocracy or other criteria.”

Kit also asked the government, which effectively owns Maybank as a GLC, to freeze Maybank bumi ruling until EPU methodology on ethnic equity ownership is made public.

Meanwhile, DAP Socialist Youth (Dapsy) members have threatened to close their accounts with Maybank if it failed to retract the ruling in the next two weeks.

UPDATES: Gerakan Youth chief Mah Siew Keong said legal firms in small towns would be badly affected by Maybank's new policy in selecting its panel of lawyers.

“In many smaller towns, a lot of lawyers are a one-man show. If the 50 percent bumiputera equity (policy) is enforced, then it means all those lawyers operating alone will not be allowed to do any work for the bank,” he said in a statement reported by Malaysiakini today.

please disclose the other bank too. i will close any and all accounts with maybank and if affected the other culprit. this is absolutely unacceptable. even if they "undo" the decission, everyone should close any and all accounts. do not provide business to banks who act like this.

Is this a possibility? Some sick-minded people with power wanted a piece of some law firms for free. So, they cook up another propaganda to 'rob legally'. It is looting season in bolehland!

Is it true that the PM made such a call for meritocracy or merely another spin by a BN sycophant?

Every now and then some jackass will wake up one morning and cook up some regressive idea. Didn't the rakyat not too long ago had to grit their teeth over some internal memo from another bank?

The board of directors of Maybank should answer whether the bank is an international conglomerate, or a national bank, or a race-based bank.

If international, its directive will win international scorn. If national, shareholders and account-holders who are non-bumiputras should sell or close. If race-based, it should withdraw any advertisement it will be putting up on tv come merdeka day, for people will scoff when they see it.

These gentlemen should instead spend better time making the bank more globally competitive, for the only reason they are where they are today is because the country has sacrificed better and more wealth-rewarding options for its citizens by holding back the onslaught of foreign banks for domestic accounts. And those citizens include bumiputras.

What's Maybank saying with this directive? That bumiputras who are professionals need to be given a leg-up when it comes to deciding who are competent enough to provide legal service? Are laws race-based in this country? Are bumiputra legal firms so non-competitve in pricing and capability in this sector that others must be discriminated against in order for them to come up? In doing so, isn't Maybank insulting its own selection acumen as well as the professionalism of this industry?

Maybank is a public-listed body; its shareholders and account-holders come from a cross-segment of the populace. By its discriminatory action, it is saying to everyone that its management has the right to waive their weighted interpretation of how social responsibility should be exercised.

Their blighted action is again one of a number:

Why did the Sabah CM crumble over purported objections from some people to the building of a statue at a particular site? Is their faith so weak, or is he too weak to stand up and reeducate minds to be more self-reliant? Do you need to impose mortal authority and discrimination in order to exalt immortal authority?

Why must the MOE practise discrimination against the parents of school-children who go to independent schools by continuing to impose examination fees when those fees have been removed from national schools? Is the MOE seeing those children as not equal to citizens of this country by dint of their not attending what it wants?

How can we talk about glocal, integration and unity when discrimination and stratification of citizenship continue even to this moment, counting days to our 50th Anniversary as a nation?

Why are these banks having such regulations? There's nothing stopping bumis from becoming panel lawyers? Why the discrimination then?
If this discrimination carries through, I will never deal with these banks again and will tell my friends around the world our country discriminates against minorities and now banks are following suit, what next?

I have closed my account. Its not difficult - just move your money to another bank. Its good to do this NOW within the next 2 weeks. This shows Maybank that there is a huge OBJECTION to their corporate objectives. The people do not bank with Maybank ANYMORE until it apologises and makes transparent its dealings.

JOIN ME. Lets make a difference in Malaysia. It may be difficult with fixed deposits - though Maybank rates are not good anyway. But, at least move all your savings somewhere else.

I am doing it now whether they are retracting it or not. We must send a message to other business entities that ideas like this should not even cross their mind.

Threats will not work as other companies will try to impose ideas like this and hope that we will not find out. Even if we are find out, they can escape easily by retracting them.

No area of business and life seems secure from NEP and open to competition, now even banks.Someone said earlier that some jackass, on waking up one morning, must have dreamed of this original idea how to make Malay lawyers, regardless od being good, rich. How true! All the Malay lawyer has to do is sleep at home and become rich. Why do we stand for all these? I have no account with Maybank and if I did, I will transfer my account today. Was not Maybank owned by Chinese earlier?

As far as I know, such similar policies have been in existence for a while except it is not practiced strictly. During the compettitive times recently , most banks actually allow any lawyer to do the loan documentation if they can bring in any customer to take end financing from them, which is good, as the more hardworking you are, the more you earn. I am now wondering why our local banks now are going backwards.Perhaps a change of board of directors is imminent to change from the mediocre to a better one. If I am a foreign fund holding shares in MBB, I would definitely query the bank as it is making the bank less competitive and put the bank at risk with lawyer of race instead of lawyer of calibre.
This is where prominent foreign investors like Marc Faber etc can give comments on CNN or CNBC and put pressure on the bank on some half baked ideas.

I've grown too fond of Maybank's convenience. Maybe I would reduce my banking transactions with Maybank, move to Public Bank the bulk of my funds.

All I can see is another Ali-Baba session. At the end, GLC like Maybank will pay many times more money than let the open market decide. Why? Let's say a small town lawyer, when GLC like Maybank do it, those bigger firms sooner or later, MUST subcontract it back, because it is never cost effective. However, this main contractor still charge the extravagant price compare to market price. Guess who is going to pay the cost at the end of the day? Yupe, it is the consumer, the sucker.

So it is just another rent seeking .

What Maybank is doing now [ DELETED ] the targets of policies to drive them out of business either overtly or covertly. Is this another sympton of a policy aginst the non-Bumiputras of this country?

We cannot just lie back, play dead and allow them to commit such racist policies against us, the non-Bumiputras without fighting back. Sure, we cannot fight back through violent means but there is always the power of the vote. And more pertinent to Maybank, our money (what little there is left with us)! I say that apart from closing our business account with Maybank, we can take out our money there like FDs, savings, etc. And when we do so, make it a point ot tell the bank's officers to relay the message to their bosses-We refuse to have anything to do with Racist companies and htis is the easiest way for us to hit back at them! With WTO, there are plenty of other foreign banks where we can put our money with, without having to suffer the ignominous racism imposed by a Malaysian banking institution.

For those contemplating withdrawing monies from Maybank... Please understand the basic banking business, which is cash deposits are liabilities, whereas loans are assets; so, to really teach Maybank a lesson is to close all loan & credit cards accounts but deposit huge amount of monies into it.

BTW, this discriminatory policies are nothing new to the banking industry since most local banks are owned by Malays. One commentator had accused foreign banks of doing the opposite but sorry friend, it is not true.

These cooked up policy from Maybank is nothing new in the banking industry. It's even worst in the oil & gas industry. Why? Because Petronas dictate all these bumi/non-bumi discriminatory policies in the whole of Malaysia.

Find me the most recent petrol station owner, and I can tell you, 99% he/she/they are bumi majority.
Find me a vendor, any Petronas' vendor, and I will tell you they are majority owned by bumi. So, you still think Maybank is "bad" here? Think again.

Must have been a terrible and tough decision to go against their masters or can we read it that the powers behold sanction it… So now Maybank’s decision is not the end as I fear
may now ruffle the other side who would now be their turn to use the 'race card'. Speaking of which we Malaysians are especially excellent in such 'card' games... each party, interest groups.. anyone with some two sen worth of pearls of wisdom seem to think they have the trump card on their hand waiting to play to the gallery-how sad this 'card mentality' i hope those who rant have played the trump card than used the 'joker' instead. So now we have gathered and sharpen our can openers, which ‘pandora-box’ shall we pry to peek whether corporations, whether GLC or private companies (latest I think poor Petronas is going to say "huh? why are we in this what did we do?") are still politically incorrect in being equity bias the way they do business. Ok I don’t pretend I’m an angel and fight for the oppresses because deep inside each of us, though the blood color is the same, we all have our prejudices and biasness, partly a result of our education system and our direct or indirect experiences and we have also the media now cyberspace to thank for making us all carry a ‘race card’ in our deep soul. While we rant Maybank at being bias and be gregarious when opportunity or rather opportunists sweep us to all resonant the same battle cry and have a free go at Maybank-bashing, are those who have ‘won’ this battle going to can open if the other bank, AMBank has such a written or rather was wiser to have played the unwritten silent game in their selection of lawyers? Any one care to now also ask the other GLC controlled bank if they do practice such policy, while the iron is hot why not singe the other banks too..

And isn’t is hypocritical we want to be in a foreign bank to seek refuge when we think that solution is found barking from a distance or biting the wrong leg. Hello, haven’t we learned to play their game, we need to be one of them. So what does leaving or taking all my out money from Maybank gives me the right to demand from a distance ‘Hey Maybank you better change if you want my money’ I think my voice is stronger if I’m a Maybank customer. That way I can irritate my bank manager to give me ‘the answer’ I want to hear. And what makes foreign bank more kinder to Malaysians. Have we checked if our foreign banks are also in countries that are ruled by megalomaniacs and dictators and supported oppressed regimes.? Let’s see if any are in Zionist land or some militant supposedly terrorist country.? Hey I ain’t got the large sum of money to open an account with them nor the convenience of transport to hunt for their branch or ATM. Does owning a foreign account or credit card won’t put me in debt. I wish the foreign banks best of luck in managing new customers who would not hesitate to leave on the slightest convenience or rather inconvenience they encounter.

So back to our victory.. okay what have we won? Only managed to take one drop of water away from the storm in the tea-cup we created but if I take each drop away then I will have emptied my tea-cup with nothing left to enjoy ranting about I suppose. But then I won’t be happy with an utopian world. So I’m back to reality at least knowing that we are threading along albeit slowly with this slow victory. But are we tackling the issue at its roots? Does replacing the management with one ethnic group bring more fairness, equity and what have you? We all know companies of whatever major ethnicity have also been crooks or not done well or even worse played and continue to practice the ethnic equity card game-our Malaysia boleh way of social engineering.. The present government have really relaxed ‘freedom’ of speech to have enabled ‘such victories’ but let us be down to earth that if we continue our rather bias approach in winning our battles we will surely lose the war. I’m holding on to my ‘trump card’ but my can opener is still at hand.. who wants to help me hope over to the other bank(s) or GLCs? I suppose the best is the ethnic base parties to ask them to stop being unfair as they hold most of the ethnic equity card and use them where it serves them well to get quotas to this group and that group and what have you…

Or maybe I’d just throw away my can opener or trump card?

Now to look for a Maybank ATM and hope it works and not do a racial bias on me and be out of service again!
