Corrupt customs officers at Johore-Singapore Second Link

I think I would like to highlight an incident that made me feel ashamed to be a Malaysian about corrupt Malaysia Customs Officers at the Johore end of the Second Link to Singapore.

I came back from Singapore today for some business and, for the first time, I decided to take the AeroLine Bus Services out of One Utama to Singapore and back. I have no complaints about Aeroline and I must say that the journey was very enjoyable with very polite crew members who made our journey memorable.

I stayed in Singapore for two nights and during that time I decided to buy the Sony PSP for my son's birthday next week. Upon our return, we had to undergo the normal passport clearance from the Singapore side and the Malaysian Side.

However, since we were entering Malaysia, we had to also clear customs with our bags opened. However, I was singled out but the customs officer who wanted to know what I had bought and I told her that I bought a PSP for my son's birthday. She said that I should be brought to the Customs Head in his office, accompanied by a male customs officer to meet this person by the name of Zainal (stated on his nametag) and that I was to pay duties for the PSP.

I explained to the Customs Head that I bought the PSP from Singapore and it was meant as a birthday present for my son and he said that I need to pay duties on it amounting 30% of the purchase price. He told me that I should pay RM50 and I wanted a receipt but he then said that for a receipt to be issued I need to pay RM100 or 50% of the RM244 (30% of the purchase price). I told him to please waiver the duties as it is meant to be a present. He then asked his officer to make the decision, and he decided that the duties should be RM50 without receipt. Of course, I left in disgust.

I am appalled that these officers and Head of Customs at the entrance into Malaysia can be so blatant and this is not an isolated incident.

I was told by the Aeroline crew that this is their normal modus operandi and that innocent victims including Japanese and Indonesian visitors coming into Malaysia via the Second Line by bus have been had by these unscrupulous customs officers and I think they should be exposed as they are doing a great disservice to our Visit Malaysia 2007. It has also left me with a very bad taste in my mouth.

I hope you could print this e-mail and that such corrupt customs officers at the entrance into Malaysia should be dealth with by the higher authorities.

My first visit to Spore after form 5 about 20 year ago. Bought a pair of Nike also was told need to pay 50% tax. So I just pay RM50 without receipt. Guess old habit never die.

This is nothing until you are a chinaman businessman having to deal with government departments such as the police, customs, JPJ and local councils, etc. This is part and parcel of doing business in Malaysia, so much so that it becomes a way of life. I am telling you this as a former businessman.

I thot that there is no duty on Sony PSPs imported into Msia?

I also thot that the prices of the PSP in Msia and Spore are roughly the same, after allowing for currency conversion?

Fyi, the Nintendo DS Lite is now selling in Spore at a "special" price of S$299, incl 2 games.

All these bribes, under table payments etc are ultimately passed on to the consumers.
By the way these corrupted crooks are going to get a pay rise I wonder if they truly deserve it.

I can imagine the std response from our leadership again if we highlight this in the mainstream: "Our customs officers are people of high integrity. Don't let one or two incidences tar the good name of the dept."

No wonder despite the low pay and working conditions, so many want to work in these sectors. Their monthly “bonuses” probably is more then their basic salary.

It doesn’t happen only in second link. I flew in from BKK once to the LCCT with four other friends. It was the last flight for the day and I was one of the last few passengers to go through customs. The customs man asked me about my trip etc.. and what I bought. Me being the honest Joe, I told him I had shirts made etc… he asked how much per shirt and how many and he worked it out that it was about RM800. He then said, “Oh you have to pay tax for that?” and I said no, this is personal stuff so why should I pay tax for them. He then said I had to talk to his supervisor. He came along and took me to this huge sign with small prints and on it pointed to some line that said that you were only allowed to bring in RM400 or something to that effect. I said well the whole plane was full and everyone went shopping (because my friends bought more then I did and they got through). The guy then gave some stupid reason like “Oh, well maybe they travel in a group and average it out they spend less then Rm400 per head”. So I said “Well there was five in my group and if you divide Rm800 by five it is less then RM400”. I packed my things and walked through. They never even tried to stop me because they knew they had no leg to stand on. Though the word bribe was never used, only a stupid person would not have figured out what they were after.

We as citizens must also do our part and pay fines/ summons only with receipt. We perpetuate it as well. If they got the law behind them and they it applies to ALL (including high society coming back with new designer bags, outfits and stones or whatever), then I got no problem with it. BUT when it is selective (low key commoners who they can bully), then yes I got a problem with it.

Shame shame. Tax payers are footing a pay rise and in return, what do we get? Same crap and inflation! Gee, thanks for the service .

They did not want see the bigger picture, those who practised corruption, enjoyed as an individual, but it is actually a disservice to their own kind, by adding on further affirmation to the global perception of Malaysia. When will their realisation arise? Their revolution wheel is turning so...so slowly on this matter. Greed has a strong root in a weak mind, it takes determination and realisation in order to uproot it. It can happens to anybody.

Dr. Muhammad Ghazie Ismail, you never think it will happen to you, and now you know that the corrupt practice is very widely spread. It is just that the Government is ignorant and consistently in denial. The truth is we have a very corrupt government from top to bottom. Period.

This has become a norm. Somebody complains today, tomorrow a bus load of officers comes in to supposedly "investigate". Before you know it, the following week the very same people doing the same old habit again.

This has been happening since the first time I crossed the causeway. And, that was about 25 years ago.

My suggestion is, head must roll. Somebody MUST go to JAIL. This is not the time for "educating & creating good values " anymore. Unless, our beloved government has the will to do that (i.e. send corrupt civil servants (and its public partners) to jail) this shameful practice will continue.

The question is will we see action taken. My answer is NO..NO...NO. Probably PM will be pissed off or Tourism Minister will be pissed off too and deamnd a departmental inquiry will be held. Meanwhile the head of customs at the border will say " It could have been brought straight to my attention immediately..no need to go to the blog media..blah..blahhh..blahh" Whether they hold an inquiry or not, is another matter..and it will laid to rest.

Or another typical response will be...Oh it is just one bad apple..so you cannot say the whole bunch of them are crooked.

And PM and the rest live happily ever after..after all this is not the first alleged report of corrupt officers.

those who offer bribes are equally to blame. how come everyone blames the customs, the police etc.? do you know how many businessmen bribe government officers so they can get away with their crimes? let me point out one story i've heard. a rich businessman in sabah has been dodging taxes for a long time. when inland revenue caught up with him and went through his accounts, he offered them a bribe to settle. when they refused, the got furious and said something to the effect of "you chinese, i'm chinese, why can't we help each other?".

Well, I am only surprised that they would actually ask from a Malay. Previously, the rule is "Cina saja"; it is not coincidental that the "tax" is calculated at 30%.

Bribery does not have colour..the only colour they see is the colour of money!

Our family & friends organised a trip to Langkawi. We stayed for 4 days and 3 nights. We bought our entitlement of duty free, and when we exited Langkawi, the customs officer asked how long we stayed and we replied the obvious. At this point, seeing that we were a big group (12 adults and 6 children) he requested for our itinerary. The boarding call was made, and we managed to produce our itinerary, but because we checked in on different flights, some of us did not have the check in stubs.
The officer then proceeded to hold back my sis and my mum,because both of them could not produce their arrival stub. Having been to Lnagkawi at least 7 times. This is the first for me. And this officer did not use his common sense! He was just happy to make us wait. He eventually let us through at the very last minute, and because we were travelling budget, my mum, who is 75 had to walk much faster than her ususal speed!

This guy could have used his brains! I wonder if anyone else has this experience? My advice, next time keep your check in stubs!

It was a ploy of the BN government to fish for the 1,002,040 Civil servants votes and another 557,033 Retirees Votes. Add in the votes from the spouses and some children, the Abdullah government just could not afford to antagonize such a big block vote.

I used to buy back few hundreds pieces of fancy watch during my business trips to Guangzhou. I was stopped and the lady custom officer trying to scare me off using the same tactic. Then I ask her is it true watches are tax free, she seem lost for words but reluctant to let me go off scot-free. On seeing this, I told her, just take a few if you like. To my surprise, she doesn’t feel ashame to take but she even wanted to choose design. I told her please hurried up because I’m in a rush and she replied her daughter prefer which design. The best part was with her handful, she ask me, “Ada plastik bag kah?” (Do you have plastic bag?).

For those who have never encounter with these kind of things would definetely feel unjust. However, those who have been undergoing similar ordeal may take it as reciprocal deal. Which way do you prefer given a choice paying a traffic compound at RM150 with a receipt or RM50 without a receipt. Either way you will get your summonses cleared at the end.The same goes to when it comes to dealing with custom officials. You only have two choices; to pay the taxable amount with receipt been issued or pay an offered amount without a receipt which normally a fraction of tax payable. Failing which your goods will be consficated. You would be more than happy by just paying a fraction rather than subjected to hefty tax.

It goes without saying that it takes two hands to clap, and no egg without the chicken and no chicken without the egg. We trying to keep discussing this for awareness of corruption and at least bring down the statistics and up our global standing. I don't believe we will get far if the discussions go racial. So please, folks, can we stay away from racial innuendos?

The Singaporeans who 'kena' will say that they target Singaporeans, the Chinese Malaysians who 'kena' will say they target 'orang Cina', so on and so forth. But greed is colour-blind. In the first place, I don't think these corrupt officers have any kind of loyalty to anyone else other than themselves.

My sister shared a cab to go back to JB from SG once, and one Indonesian lady stuck some notes in her passport at the last minute. Haggling ensued, the passport was passed back, and more money was added to the pile. I guess that's how illegal immigrants get into Malaysia, not just on boats, but in the comfort of air-conditioned cabs.

I think Malaysians to travel anywhere should know their rights and the law. Those finely printed text in your ticket, and on the back of the glossy airline magazines are actually useful in case some corrupt officer (in Malaysia or elsewhere), decides to pull a fast one.

Actually, the next time something like this happens, we should take a picture and then tell them we're sending it to Jeff Ooi. Baru depa takut.. heheh!

I don't find it shocking at all what Dr. Ghazie had experienced. Abuse of power & corruption is so common in this region. That is why we're still called the third world nation. Let's find out how Finland/Sweden/Switzerland did it (corruption rate almost zero) and see where we can emulate them. It's not wrong to copy what's good for the country. Nevertheless, I can't help being cynical about it. Who's gonna rock the boat? Heads gonna roll? I believe it only when I see it.

For 5 decades every Malaysian shopper knows what to expect at customs checkpoint. Bribe, try wriggle out or pay whats due.
The blardi tax issue for small items has to be abolished. You want to tax, tax those who bring by bulk for commercial intent..not the tourists bringing in small items once a while.
The whole greedy tax policies where EVERYTHING OSO WANNA TAX only breeds corruption with NO end in sight. Ask a 1000 people each bringing 1 item each whether they know how much each item is ACTUALLY LIABLE for tax..I bet NO-ONE really knows for sure. What happens next is the customs officers inflicting any amount that'll be a hassle to verify. There's NO transparency or documentation friendliness at the checkpoint. In short, everyone is AT THE MERCY of the authority involved. There's NO end as I see it..This is BOLEHLAND!.

I am actually surprised for someone like Dr Ghazie to succumb to this criminal act by the custom officers.

About a year ago, I bought 2 used cellphones through eBay that was delivered from UK. Seller sent goods through AirMail. My parcel was stopped for custom clearance at KLIA Post Office which required me to go personally to collect or appoint an agent to clear item for me.

I went there expecting to pay the appropriate duties for the phones. Instead of a straightforward procedure, the custom personnel who attended to me said that since this was a phone I should have obtained a "SIRIM" approval to import it. In addition there would also be a 10% duty on the product.

I told him I am prepared to pay duties and requested for more information the relevant rulings on SIRIM approval so that I can sort it out. Instead, he suggested that he could help me bypass the SIRIM approval because it will take a long time to process officially. I told him I prefer the to do things right even if it takes a bit longer as I plan to buy more phones in future. He repeated his offer to help if I agree to also "help him and his friends". This entire conversation took place in the customs hall in broad daylight whilst the other 5 customs personnels conveniently had their heads and glance turned away from us. I felt there was an invisible "force field" shielding me and the first customs personnel!

Wondering what a thick a skull I must have not to jump at his magnanimous offer of "assistance", he looked me in the eyes and asked, "Awak faham tak apa saya cakap ini?" (I thought to myself, "Of course I do, you corrupt criminal!"). I replied,"Saya faham, tapi hati saya resah menimbang perkara ini. Saya lebih suka betulkan apa yang tidak lengkap dari SIRIM".

At that moment, he stopped the conversation and said, "OK, pergi ke sana, kaunter taksiran untuk bayar duti", realising he wasnt going to convert me.

I proceeded to another counter and met another personnel. After a brief Q&A - how much I paid for phones (I showed my ebay invoice) and how much is the model selling in Malaysia, he assessed the phones as used and charged me 10% duty. I paid the amount and with that receipt proceeded to claim package from the Post Office counter.

You may like to know that during this whole episode of 20-25 minutes, another lady came in (10 minutes AFTER me) manage to leave 5 minutes before me with a brand new spanking Pink Motorola Razr, without being jockeyed from 1 counter to another.

I guess Dr Ghazie had options but he made a sub-optimal choice. By doing so, he ensures the very act he is condemning is repeated once more and likely to be perpetuated a lot longer.

Everyone of us have a role to play to rid ourselves of the wrongs in our country we do not wish on our children and grandchildren.


Greetings, Dr Ghazie. I'm writing anonymously, but we have met many times before in your previous position. As a member of the official "establishment" you probably never expected to meet this situation. Actually this is a common occurrence at the Causeway, and various other land entry points to the country.

As a corrupting AhBeng (It takes two to Tango) I normally just pay the unrecorded "donation". I pay less tax, he gets to pay off his new car. You happy, I happy, semua OK.

These guys show what is meant by being true Malaysians! And since they are so good at it our PM is going to reward them with a 30% pay increase!!

Dear Jeff, reading this post brings back to memory a similar incident I had at KLIA some time ago.

It was Sept 31st 2002 ( I remember this date coz it was also our national day), i had arrived back to my country after spending 5 years in OZ, and I was only 23, a naïve romantic thinking of a wonderful future awaiting me.

I had with me a PlayStation, the original one, grey in color. my girlfriend gave it to me as a xmas prezzie thus making it at least 9 months old. really appreciating the PS, i kept it in very very good condition, wiping it ever so often and dusting the lens and whatever, and i even kept the styrofoam and the whole bloody box.

so i was at KLIA right, the bozo at the customs enquired. "APA ni?" "oh.. playstation lah... tv game i replied smiling" unaware that i was being sized up.. he asked what i was doing overseas, what flight i was on? where had I studied, then he popped the question... said i had to pay tax if I wanted to bring it in.

foolishly I told him my story, hoping he would understand the heart of a young man in love, and WOAH!! Guess what he did…. He took a smell at the PS controller… and said “ni baru nie…” OMG… how low can you get.. he was one of the guys with the big shoulder pad uniforms, telling me, I got to pay him RM150 or else… screw him.. I stood there arguing with him for like 20 mins until…

Eventually it finally dawned on me that this was a classic textbook case of “duit kopi”… sigh… and the rest I believe is history…. I did get a receipt for it but it really is a dodgy receipt…. Its like one of those you get at your corner grocery store.. but the thing is.. I think this thing goes all the way to the top… coz after I was done “negotiating” with him… another lady in uniform came over to “calm” me down and directed me to the payment counter… sensing something very wrong when I got the receipt, looking dodgy and shit. I requested a proper custom declarations receipt/form/stmt/ whatever…. But all I got from that cashier girl was… a standard null looking expression and a “I don’t know anything at all” reply…

I was disgusted. But what could I do. I was 23, left the country when I was 18. young, dumb,naïve,helpless,clueless and not registered to vote. Not that it mattered anyway.

Deep down. I am still bitter. Hell no, not because of my hard earned $$$ from my part time work back then. But reflecting the fact the somebody high up like our good doctor from mdec to somebody insignificant like me can also face incidents like that…. Something is really wrong with the system. How can things happen and nothing happens.
I stay in JB, and have more than my fair share of stories about the Malaysian side of custom.

This sucks man. Especially when you are overseas and people ask you where you are from. The powers to be, please do something.

What ghazali experiences is something that occurs very frequently and common. Asking for 'duit kopi' is a common phenomenon and has been practiced for a long time. Honestly, how do you expect a govt officer earning less than Rm2000 not to resist any bribes at all.

The fact remains that Malaysia is a corrupted country. I doubt that much would change to their corrupted behaviour despite the pay increase.

On the bright side, thanks to corruption, pirated Movie and song DVDs are abundant in Malaysia. Try going to Sri Petaling's Pasar Malam and you will find one corner selling all porn DVDs. The variety of porns available is like nowhere else in the world. You will find the latest porns from America, Europe, Japan, Thailand and etc.

Anyway, the pasar malam is held every Tuesday night which is tonight!

But i stand by nick. clumsy sometimes but a patroit nonetheless. ;)

Recently I imported some urgent computer parts from Korea sent to me via our premium EMS service (handled by POS Malaysia), I got a letter from POS Malaysia that my pracel sudah "di tahan" by the custom. I was told to appoint them as an agent. I must bear the RM150-200 charges.

Sensing something not quite right, I told POS that they ought to be responsible for the custom clearance and computer parts are not taxable. But to no avail.

Instead, the clever me, went to the POS Malaysia Clearing house next to the LCCT. Armed with all the parts catalog, sample etc. I thought it should be piece of cake with the custom department as I am a bona fide importer.

To my surprise, the custom officers agreed with me that it is tax free. The catch is that you must appoint an agent to clear the custom. There will be no duty. The only one available there is POS Malaysia. Again, the cost is the same. Back to square one. I beg the officers to exercise fairness as the goods are tax free. They should have released it to me in the first place. But no such luck. They like to “ikut” procedures.

The officer reminds me that I won’t be able to get the goods for a few days. However, he suggested to me that he can save me time and money. Perhaps another long trip to KLIA. I was disgusted with myself but left with no dignity and no choice but…..Instantly, with a chop on the document, I was on the way home with the parcel. Warp speed indeed.

It is clear now how the corrupted custom officers enrich themselves and yet “helping” people like me to get my goods fast at a “discounted” rate. All they need is to stamp a few “DI TAHAN” on your parcels. Cukai or no cukai…still collect. That is the beauty.

Somehow, it struck me that instead of the authority or some ombudsman, any complaint against public official misdeed get reported to private citizen instead of the relevant party.

I'm not naive just that, Malaysia has gone down the drain in good public governance.

My "salute" to those who continue to soldier on in spite of the odds.

Who Cares? Malaysia rots and decays. Soon it may be every man for himself like in Darfur, women and children not excluded.

Since so many of you sharing the story, I also share mine.

About 10 years ago I went to Singapore to drive back a van full load of used computer for a school. Many are 486 and the highest is Pentium (not even MX). Some printers and tables. Well, we helped cleaning the rubbish for Singaporean for free or else they have to pay someone to get rid of it! For school, it was my charity.

Ok, it was quite smooth to pass thru Singapore. The custome asked for purpose and let us pass thru.

When reaching Johor custom, those bastards were excited because, man LOTS of stuffs! I told them this is old computers, rubbish, for school and computer has no tax. But they gave me problem. They said I need to declare. OK, let's declare.

So I drove one of the bastard to the declaration office (he sat in the van to show me the way). On the way, I noticed that I already passed the cusom gate and ready to go into Johor! That bastard actually asked me if I wish to go by giving him RM50!!! Along with me is my friend, who is a teacher. He said, no, we are teacher, we don't do that thing...

OK fine... the bastard brought us to the declaration station. His superiors came out and said, "man, what a work! Any document?" Of course no. They asked us to leave the van to them and wait. We waited a straight 6 hours, from early morning 9am to 3pm!

We got back the van, nothing was removed from the van. And they charge us something like RM200. We asked why? (because we knew computers no tax) They said "cable" is not tax free.

What cable? Oh, those Printer Cable!!! We have about 20 printer cables... Then we asked, why we have to wait so long? They said, "because you make us work! we have to find something to tax you!". Bastard...

The only way to evade all these nasty things is just by befriended with senior custom officials. They are expecting some sort of 5 star hotel stay plus karoake session with extra-extra services to deliver truly efficient services.

Now that this has gone global and all eyes are on this country, one can only hope the cabinet will swiftly act on this matter once and for all.

It's not about tax evasion or coercion. It's about plain blackmail of the rakyat and visitors by civil servants of the state taking advantage of their position and making a mockery of the image of the government and the country.

First the rules suck. One would have thought all IT products and parts would be exempted from tax and duty by now, given how convergence has made one indistinguishable from the other in notional function.

Second the interpretation of the rules also sucks. How it is interpreted depends on the officer on hand. Too many examples above show they twist it to serve themselves. They might as well take off those uniforms and wear black; that's the shade of those night owls.

Third the implementation of the rules also sucks. Official processes are twisted to create loopholes for the crooked hand to go through and open up for under-table collections. That makes it official blackmail and this country no different from one neighbour at least, some say worse.

Fourth, it insults the integrity of everyone else who tries to abide by the law, including foreigners, and this is especially bad when we think about it - who would carry a customs tariff book of duties payable across the checkpoint each time he walks through to know whether what's asked is correct or not.

Fifth, it reinforces that we have become a rent-based society where people take the reason of not being paid on par as their excuse to use their positions to cheat the national coffers, cheat the people and make it easy for others to follow their path.

Sixth, if the cabinet doesn't come to a decision on this, it shows they condone corruption. No if's and but's about this.

Coming soon is that hefty raise in salary increment. Also a new billion-ringgit Customs integrated complex in crime-and-rape infested JB. Can they join the dots to complete the shitty picture?

My take is that unless the guy's bringing in gold bullions by the bricks, nothing should be taxed; not even clothes. Taxation should be based on commercial quantities adjoined to mode of delivery. They just need to refine this and make sure everyone knows it.

It makes no sense in the end anyway to try and tax things in this globalized world. They should be working towards reciprocal openness.

And yes, Ghazie did look a bit you-know, years ago anyway when i remember him as one of the young industry stalwarts. He did right to bring it up.

Just drop all friggin' taxes, duties etc based on that notation and move on.

Meanwhile, the aca on this matter, the toll agreements details, the 1.5 million illegal mykads inquiry, the mongolian case, the....

Dr Ismail should write a complaint letter to the Director of Customs in KL as well as Johore. If I am not mistaken, it was reported not long ago, in The Star, the Director himself assuring everyone that all complaints will be dealt with. I too had bad experience with JB customs, one of them threaten to "rampas" my handphone and another called me "bodoh", just because I questioned them abt them imposing tax on my used amplifier. Wonder how many of those daily workers who go through JB have been "terrorised" by these people. The new ACA director shld begin to look into endemic corruption in such places.

How about if we carry this through by reporting to the Custom Director and see what is the result. We can keep track of this case in one form or another...the internet is one very useful tool.

Jeff et al has opened up a certain level of awareness, avenues to create public awareness for better and improved good governance.

Undeniably, it can be demoralizing when confronted with the enorminity and sheer inertia of our institutionalized sense about corruption and other misdeeds, we do what we are able to do.

Without loading on Jeff's limited resources any further, any possibilites of us others to play a role in monitoring such low level breach of public confidence?

To begin with, lets say Dr Ghazie write in to the Director of Custom to complain, the "clock " can start in the monitoring process as to the speed of acknowlegement, the further response from their internal investigation to Dr. Ghazie and the outcome of the investigation can be monitor online. At the same time, others can log on their own experiences and cases to enable Malaysian to keep track with a certain degree of objectivity about the actual situation.

Nevertheless, this sound a little naive and wishful thinking but is there any harm in trying?

On Sunday, barely a week after they announced the increase in civil servant's salary, I was stopped by some by shit policeman. Reading all these, I am very glad that my application for another country's PR (permanent residence) has come through. So maybe another brain drain for Malaysia is worth nothing.... But I do know of at least 10 other friends / business associates who are doing the same like me because of all these corruptions. So let's see what happens if this is to continue for another 10 - 20 years.
