Here is an update of some developments pertaining to the defamation suit filed by The NSTP and 3 Others against this blogger.
I have instructed my lawyers, under Order 4 Rule 1 and/or Order 92 Rule 4 of the Rules of the High Court 1980, to apply to have my case (Kuala Lumpur Civil Action Suit S6-23-3-3007) consolidated with Rocky's (S3-23-2-2007).
The Summons in Chambers pursuant to my application for consolidation was filed by my solicitors, Messrs Thomas Philip. The sealed copy of the application was served on the plaintiffs through their lawyers, Messrs Shearn Delamore, yesterday, March 20.
The application will be heard in chambers at the High Court of Malaya Kuala Lumpur (S6) at 9.00am, April 4, 2007.
Rocky's case, currently being heard before Justice Hishamuddin Yunus, will proceed at the Kuala Lumpur High Court (S3) as per scheduled at 9.00am, April 2, 2007.
In my application for consolidation, I prayed
- That my case (S6-23-3-2007 -- "the S6 action")) be consolidated with Rock's case (S3-23-2-2007 -- "the S3 action:") and do proceed as one action under the S3 action;
- that the title of the S3 action be amended, by adding to it, the title of the Kuala LumpurHigh Court Civil Action No. S6-23-3-2007;
- Pursuant to the order for consolidation in prayer 1 above, such further terms or directions pertaining to the consolidation as this Honourable Court thinks just;
- Any further and/or other order this Honourable Court deems appropriate;
- Costs of the applications herein be costs in the cause.
The brief grounds of this application are as follows:
- Some common questions of law or fact arises in this (S6) action and the S3 action;
- It is desirable to make an order for the consideration of this (S6) Action and the S3 action as the consolidation will:
(i) lead to saving of time and costs;
(ii) ensure that decision of an inconsistent nature will not be handed down by the courts.
The foregoing grounds are elaborated in an affidavit affirmed and filed by the defendant with the High Court.
