For whom the tolls toll?... ( 2 )

There's seems to be more to the story when KeAdilan information chief Tian Chua revealed yesterday that Works Minister S. Samy Vellu has been lying through his teeth about the government's effort in negotiating, and compensating, the concessionaire in order to help lessen road users' burden. Recap:

"There's no such thing as the government having negotiations with the concessionaires (to reduce the toll charges for road users) because the government was already agreeable to the stipulated toll rate, and subsequent increases -- based on a formula stated clearly in the contract."

"The truth is all this is just wayang as the government has already agreed to the toll rates when it signed the concession agreement that is lop-sided and against the interest of the rakyat," Chua said.

Here's the evidence that Chua and KeAdilan Treasurer Khalid Ibrahim showed the Press yesterday.

In the section titled: Reduction in Toll by Government of the concession aggreement signed between the Government and Litrak on April 23, 1996, Page 47, Clause 16.2.1 stipulates that:

In the event that the Government imposes Toll for any class of vehicle for or during any Concession Year which is lower than the Agreed Toll for that class of vehicle for that Concession Year then the Government shall compensate the Concession Company, in respect of the relevant Concession Year when such action was taken ("the relevant Concession Year"), and for each Concession Year thereafter during which the decision of the Government continues to apply by paying to the Concession Company an amount certified by the Operation Auditors to be calculated in the following manner:

CA = ∑ [AT x (2 x TV)] - TA

The amount of compensation shall be certified by the Operation Auditors and shall be payable within ninety (90) days from the date of the joint certificate certifying such amount from the Operation Auditors of the end of the Concession Year.

As such, the schedular increase in toll rates throughout the 33-year concession period has been stipulated in the concession agreement as is summarised as follows:

December 14, Samy was quoted by Bernama as saying that "despite the Government agreeing to increase toll charges at five highways from January 1, it still has to fork out a hefty RM2.58 billion in compensation".

On this, Chua added: "Look again, the agreement also states that Litrak is allowed to increase the toll charge to RM2.10 from 2007 through 2015, and then increase to RM3.10 from 2016 to the end of the concession period, provided there's no extension."

"But the real issue is this: The toll charges, and the compensation, do not reflect the actual cost of building the highway, and the amount of cash that Litrak keeps collecting from road users after it has recouped the construction cost," Chua cautioned.

Samy 'dreaming or suffering from amnesia'?

Meanwhile, Parliamentary Opposition Leader Lim Kit Siang has refuted Samy Vellu's claims that the former was once allowed to pour through highway concession agreements for nine hours without finding any flaws.

He said Samy “must be dreaming or suffering from amnesia” when he made the allegations.

Kit said, after having raised strong objections in Parliament during July 1987 on the Letter of Intent offered to then United Engineers Malaysia Bhd (UEM) to construct the North-South Expressway, Samy offered DAP MPs a glance at the tender documents.

Kit claimed that the concession agreement was eventually awarded to UEM in March 18, 1988 and he never got to see it - because he was incarcerated under the Internal Security Act at that time.

At the press conference yesterday, members of the Anti-Toll Coalition from PAS and DAP also questioned whether the terms of the concession agreement that the Government signed with Litrak, which was obtained by KeAdilan, apply across-the-board to all existing toll concessions throughout the country in a cookie-cutter methodology.

i passed by the Puchong-Sunway LDP toll yesterday nite, and then turn into Kesas. can you imagine the anger that I felt when I saw the new toll rates?? rm1.60 for LDP, and rm2.20 for one kesas toll.

sometimes when i want to cut cost going down to subang, i take kesas (pay 1st toll) and then exit at LDP sunway. so it's only rm2.50. now is rm3.80. wah lan eh...even more expensive then last time when i use kesas. rm3 also expensive for me already..considering i need to make a return trip. used to be rm6 per trip..or rm5 is i use the ldp sunway.

Had the Concession Company be required to charge a lower toll, the compensation paid (based on the formulae) to the Concession Company plus the aggregate toll amount collected by the Concession Company would far exceed the Agreed Toll in the agreement, This is due to the factor “2” in the formulae. Compensation that I understand would be to make good what the Concession Company loses out as the result of the lower toll that the Government imposes. Compensation should not be an extraordinary gain to the Concession Company

My question is why did the Government sign such blatant one sided agreement that heavily penalized the Government in the event that the Government imposes toll that is lower than the Agreed Toll. This does not sound commercially appropriate and definitely smell a rat.

The Executive Chairman of MTD InfraPerdana Bhd (the concessionaire for the Kuala Lumpur-Karak Highway and its extension, the East Coast Expressway 1), Dato' Dr. Nik Hussain Bin Abdul Rahman was Deputy Minister of Works and Deputy Minister of Telecommunications and Posts from 1976 to 1984. A number of the other directors are his family members.


The Dato’ Yu Wen Chieh, previously the Director-General of the Malaysian Highway Authority, is a director of MTD Capital Bhd which owns 79% of MTD InfraPerdana Bhd (the concessionaire for the Kuala Lumpur-Karak Highway and its extension, the East Coast Expressway 1). Dato’ Yu is also a Senior Independent Non-Executive Director of Metacorp Berhad.


The Chairman of Lingkaran Trans Kota Holdings Berhad (concessionaire of Lebuhraya Damansara-
Puchong (LDP)) Tan Sri Dato' Ir. (Dr) Wan Abdul Rahman Bin Wan Yaacob was with the Ministry of Works for 32 years, having served the last six (6) years of his stint as the Director General of the Public Works Department before his retirement in 1996.


Dato' Haji Azmi Mat Nor, director of Gamuda Bhd (operator of the KESAS highway), was the Assistant Director in charge of the design and coordination of the Central Zone Design Unit under JKR. He is also a director of Lingkaran Trans Kota Holdings Berhad (concessionaire of Lebuhraya Damansara-Puchong (LDP))


A number of family members of the late Datuk Lim Ah Bak (of Taliworks Bhd) are major shareholders in LGB Holdings Sdn Bhd, which in turn is indirectly a major shareholder in Grand Saga Sdn Bhd, the operator of the Cheras-Kajang Expressway. Selangor government-listed infrastructure arm Kumpulan Perangsang Selangor Bhd had a 42% stake in Grand Saga in earlier years. KPS is believed to have sold its interest in Grand Saga in 1999/2000, before it was listed in 2003. The Chairman of Kumpulan Perangsang Bhd, Dato' Haji Abd Karim Bin Munisar, is also the Chairman of Taliworks Bhd. The Managing Director of Kumpulan Perangsang Bhd, Datin Paduka Juma'ah Binti Moktar, is a Director of Taliworks Bhd.

From what I can see, I was screwed by boss and customer today, and when I go back home on the way, I will get screw by garment another round...

One way to protest against the toll hike, stop using the Touch N Go card and pay by cash with the largest denomination note you can avail of or just one sen coins. When the toll booth could not provide the change or take time to count the coins, a huge jam will build up. Then all the motorists blast their horns to show their displeasure.

Funny thing is that it might be cheaper to fly from KL to London rather than drive from KL to Perlis. Tax not included of course but it's the thought that counts

Thanks usual_clauses for the insight on the benefactors of our miseries ! I being the ignorant member of the toll paying rakyat can only speculate that these benefactors are just part of the 'syndicate' that will laugh all the way to the bank and I am sure semi value and TM are aware or part of it!
What we can do is rant ,write to Jeff Ooi's blog ,take alternate routes whenever possible ,vote wisely the next time and pray hard !
As to the gomen buying out these contracts I feel will not take place as it tantamounts to admitting officially that it was a scam in the first place!
I urge all of us to do what they can to make sure we get screwed less hard and often knowng the way the cookie crumbles with these rent seekers...sigh .

by taking alternative routes you are basically paying more for petrol. So why are we taking it out on our own money just to make the hi-way robbers suffer a bit?

The issue is not about taking alternative routes but that the govt cheated us all. We are still going to be cheated in the next two decades...if we are lucky... and that the govt does not extend the current toll concessions.

What are you all going to do about it? Start by showing your face at the anti-toll demo tomorrow at Sunway Pyramid. Then vote BN out.

Thousands expected at anti-toll hike demo

Opposition parties and consumer groups are planning a mammoth
protest against the increase in toll hikes for five major highways
in the Klang Valley.


It is learnt that thousands are expected to turn up at the protest
which will be held along the Lebuhraya Damansara-Puchong (LDP)
highway on Jan 7.


PAS Youth chief Salahuddin Ayub said the Islamic opposition party
alone will bring between 5,000 and 10,000 protestors.


"We are sad that the government is not considerate towards the
people, especially those with low incomes," he said when met after a
closed-door discussion in Kuala Lumpur last night.


The hour-long discussion at the Kuala Lumpur and Selangor Chinese
Assembly Hall was attended by DAP Seputeh MP Teresa Kok, Parti
Sosialis Malaysia secretary-general S Arutchelvan, PAS treasurer
Hatta Ramli, Parti Keadilan Rakyat information chief Tian Chua and
Malaysian Trades Union Congress (MTUC) president Syed Shahrir Syed
Mohammad.


A `Protes Kenaikan Tol' committee has been set up and will be helmed
by Syed Shahrir.


Last week, the government announced that the toll rates for the five
highways will rise between 20 to 60 percent effective Jan 1. LDP
will see its toll rise from RM1 to RM1.60.


Tian said the Jan 7 protest will not only see the participation of
party members. "Local residents who are unhappy with the toll hike
will also participate, " he added when met at the same venue.


Syed Shahrir said the committee has yet to decide on the exact
location to hold the protest.


"It would likely be somewhere where there are parking spaces for the
protestors. We would not be blocking traffic. However, we would be
visible to road users.


"It's a big mobilisation. I don't think it would be solely because
of the toll hikes. The public is very angry at a combination of
things that happened this year, including the fuel hikes," he added.


Buy back highways


The committee will also submit a memorandum to the Prime Minister's
Department on Dec 27 denouncing the toll hikes.


The memorandum will call on the government to make public the
clauses in the concessionaire agreements and to buy back the
concessions.


Works Minister S Samy Vellu disclosed that it cost RM4.13 billion to
construct the five highways: LDP, Shah Alam Highway, Cheras-Kajang
Highway, Kuala Lumpur-Karak Highway and the Guthrie Corridor
Expressway.


The minister also revealed that a RM2.589 billion compensation
package for the five concessionaires was to be incurred from Jan 1,
2007 when the new toll rates take effect to the next review in toll
rates, which is between 2010 and 2012.


Samy Vellu also said the government had to compensate a total of
RM2.275 billion to the operators of four of the five highways, not
including Guthrie Corridor, which is a new highway.


However, while he gave a breakdown of this figure, he did not
specify over what period of time this amount was paid.


But going by this, the government could be paying as much as RM4.9
billion in compensation alone for the highways.


Opposition party DAP has urged the government to buy up the five
highways by paying the concessionaires RM4.13 billion for the total
construction cost.


In a related development, DAP will proceed with the Dec 31 protest
at the Grand Saga toll plaza along the Cheras highway. The protest
is jointly organised by the Bandar Mahkota Cheras Open Access Road
Action Committee (BMC-OARAC).


On Sunday, a protest organised by DAP and BMC-OARAC saw some 800
people taking to the streets in Cheras to vent their frustration
against the toll hike.

To save the people and the country for the next 22 years, as pointed out by Jeff, looking forward, the solution is to NATIONALISEi.e.taking over the highways and similar institutions and run as State owned projects. Use the Petronas money or ask World Bank to finance.
I sincerely do not expect the present Government to act in the interest of the nation or her people. The reason is simple- while those making the current policies may have changed, the beneficiaries have not although the GROUP may be different, taking turns to suck the country dry.
But the people have a choice coming at the next General Elections to be held within the next two years.
It will take men of quality, integrity and foresight, Nationalists,I call them,prepared to act in the best interests of the country with no other considerations.If such a group can be mobilised, nonracial but from all ethnic groups, the people will respond and elect them. The time is ripe for such a movement, in my view.
Is there such a group out there prepared to take up the challenge and are our people ready to support them are the big questions to be pondered and acted upon.

Personally, the toll increase does not affect me much. But, I see the righteousness in the action of supporting a good cause.

Ok, the problem has been laid out. What about the answer? What should we do then?

A contract has been created and I doubt it can be be rescinded cheaply. Even IF the oppositions come into power, what can they do? Can cancel the contract without any form of compensation to the operator. Nationalising the project by force will kill of free enterprises in this country. FDIs will avoid our country like a plague. So, what can we do? Instead of demonstrating, why don’t we take that opportunity to brainstorm on this?

But first thing first, somebody must bring those who discussed and agreed to these lop sided agreement to court for failing to represent for the best interest of their client, i.e. you and me. There are no reasons why we must forget the past and let the culprits retire in peace. By punishing the guilty will set a precedent to the current administration.

There isn't really much point complaining if one can't propose a solution. We must now think along tose lines. This may require lots of heads and a good deal of brainstorming, not to mention hard work, but nothing worthwhile is won without a fight.
Pardon my naivety, but do we have such a thing as a 'class action suit' in Malaysia, where a group of people could take the government to Court over what is clearly a very disadvantageous deal? (to the Rakyat, people, not the fat cats)
If we all chipped in RM1, or even RM10, the cost of a day's tolls for many, the costs could be covered.

The gov (opposition or what) has to re-negotiate the contract. Probe these suckers why they need to increase the toll so much when they are making so much money already, futhermore now the economy is not good, most citizen got no salary increment since 1997. Likewise, most bank revise their interest rates base on market performance. If the market performance is bad, why are they increasing the toll just to generate false market perf to convince investors? The moneys come from us, and they forced it onto the consumers, we are not willing to pay for that, they have to understand that. The blood suckers have to realise they are too much, if those buggers still stubborn, the gov should buy back the concessions at cost + some markup for their profit.

and another thing. I guess we get to see the Litrak contract because someone somehow had access. (Hopefully it can't be traced so that poor fella has to go off to Kamunting)
But what about the other contracts for the other roads? I'm sure they are all 'cut and paste' with only the names changed.
Don't hold out much hope that we will get to see them from the official channels though. Unless they all started spilling the beans on each other! Look to the intriguing comment made by Rafidah about DSV!

All the formula is saying is that the govt will pay the difference between what the toll operators would have gotten if the rate has been increased according to contract and the rate that they are charging now, based on traffic volumes of the past 6 months.

Frankly speaking, I did not see anything in the information "exposed" that suggest that the toll operators are taking you for a ride. I am not suggesting that they are not, just that the "evidence" displayed does not show it.

Personally, I am for increasing the toll rates - let the people who want the convenience of using toll roads pay for it. When the govt compensates, all taxpayers pay for it, whether you use the road or not. If the rates are increased, and no one uses the roads - guess what - the toll operators will suffer.

The money used for compensation can be utilized in other ways, e.g. build toll-free alternative roads to the toll roads.

Protesting the toll increase just plays in the hands of the toll operators. The govt have to pay them anyway according to the agreement, and since more people are using the roads because of the lower rates, the toll operators gets a higher compensation(based on the formula shown) !

Good news,
The oil price has now dropped below 60USD per barrel yesterday, should starts demand the government to starts preparation on lowering down our gasolene price too. As an alternate way to subsidize the road users on the hike of toll price.

Our government is cash rich, doesn't have to fork out money to construct our highway. So the duit is senang, jangan-jangan ambil duit senang ini di hagih-hagih untuk perhimpunan agong, should hagih it to subsidize for our fuel hunger SAVVY or MAVY national verhicle.

For those who did not understands the magic of the equation, here I would like to quote for a example in real life.

Sigma E = summation of all type of payment for wife

AT= Agreed Tariff, which is agreed to gives wife, says RM30 per entry.

TV = Traffic volume, says you make 3 entry per week, total 156 entries per year.

TA = Total acknowledgeable last year to your wife, says 2 entry per week times RM30 = RM3120

And the equation is: Sigma E = ((AT x (2xTV))-TA

Sigma E= (30 x (2x156))-3120 = (9360)-(3120)=6420

Therefore you need to compensate to your wife on her acceptable entry for this year is RM6240,

It means that you will need to double up your payment to your wife for her maintenance expenses due to yearly wear and tear every year if she did not able to collect any extra income from her allowable increased entry. So you understand me clearly now?

I wonder which mathematicians is doing the economics, is from your wife or is from you yourself.
But I believes it must be from the observer like Sammy Valu, because the matchmaker understand better then you really.

the coming 21 years are important. As voters we need to get wise.Vote for a strong opposition as the Bn govt can't do anything much for the people even with a huge mandate.

If you have problem voting for opposition liek PAS, cast a spoilt vote. We need to send a message to BN and UMNO in particular.

Despite what Jeff says about not being yesterday's man, I think we should examine why something like this was allowed to happen under the previous PM's watch and learn from the mistake. What cannot be undone, we can remember. This will serve as a reminder to the present minister that those who abuses the rakyat's trust will see their legacy condemned and their name spit at for generations to come. Like the Chinese say 遗臭万年.

If an ordinary outsider like me gives comment, then Mr Prime Minister, please do not always think you enjoy people support.

So the delayed action minefield sown by Dr M may well cost BN to lose more and more of its strangehold on power in Malaysia? The cost of his excesses grows worse with each passing year. The pinch is being felt more and more by ordinary Malaysians. Pain which translates into votes lost by BN?

Grossly lopsided toll concessions which will burden even our chldren.

Putrajaya, Sepang F1, Perwaja, Proton, MAS, Bakun, IPP contracts. Indah Waters. Privatised water supply. Privatised parking in the Klang Valley. Even the hologram stickers on medicine and security labels on cigarettes. And more which my mind may be refusing to remember.

A whole entrenched culture of awarding projects and concessions which the rakyat is suffering from and questioning more and more. A culture which appears to be still doing fine.

Witness the awarding of the contract for the 2nd Penang Bridge. Have I missed something, or was the massive juicy contract awarded without tender?

Will the seeds sown by Dr M prove to be the downfall of UMNO in particular, and BN in general?

why not drag the concession to 100 years? most of drivers (in their 20's or 30's) will be paying for almost a whole life anyway... when it ends in 2030s. i think better for all, at least for now. when economy really booms, restructure the concession period.

whilst some are still reminiscent of what Tun M did or did nothing in 22 years in office, it is true that we will have to bite the bullet again for another 20 over years for this so-called concessionaires' exorbitant fee

there is also another bad thing about this toll increase :-

The time taken previously to pass the toll has been PROLONGED by a few more minutes since in reality, when changes are being passed back to the toll users, the speed at which it is being given out has caused a massive crawl stretching back a few hundred metres from the time than previously. I am talking about the toll in LDP Puchong-Sunway and as well as Kepong.

why the heck are they protesting against litrak when the deal was brokered by the numbnut named Samy Vellu?

Shouldn't they be asking him how he could have signed such an agreement on behalf of the rakyat without putting our needs first?

What we need last time is a visionary leader, who will take the country to another stage. All the projects planned, might be in a good intention, to make the country progress. Who wants to continue to import things from other country when you can have one? What you will feel that every time you have to take SIA to fly? (well, it’s not really relevant, but just want to give you a point) Saying project like Twin Towers is a wasted is at the same like insulting Taiwanese on their 101 and Chinese on the Great Wall of China… (you might say why you need to build such huge and long walls which doesn’t help you to avoid being conquered by your enemies?)

Sometimes, good intention in the beginning will turns to making the wrong decision at the end. When you have a vision, you shape it but unfortunately you will still need your trusted people to carry out the execution for you. And sometimes, not always you can wish all your trusted man to be good. People taking advantage on the loopholes and betray the trust, it’s common. Momentary misjudgment or greed sometimes tends to grows into point of no return. You wish to have dream, but when you rely on someone to build it for you, sometimes it’s ruined.

We all know it’s difficult to run a company without the help and trust of your staff. How often you can be so influential to penetrate into the heart and soul of your staff? And sometimes there will be bad apple that spoils the whole basket. It’s easy to remove them when it’s only apple. But you are talking about people such as CFO who holds your company account information, Project Manager who is close and influential to all the ground staff in the case of running your own company. How easy is to remove them without thinking of consequences? And now we are talking about politics… how easy is that?

How many times we also walk the same path, having good intention in the beginning but ends up hurting someone due to our bad decision…? It happens… How many times our good intention might be interpret wrongly by the people? And how many times people will continue to dig deeper to the wrong impression but forgetting to seize the moment and seek for correction and truth?

If we want to walk down the path of continue to blame the past, where will we end up? Do we want our future to blame us who is living now in the current time, just whines and fails to strive for correction?

Think about it.

Actually when the idea of privatisation poped in, the economy was still booming. The former PM made use of the more efficient private sector to boost the country's development. This contract was signed in 1996, that was when KLCC still under construction, that was the time where everyone did not worry about not having a decent meal for the day.

If not mistaken, the lob sided contract was designed to attract private investment during the boom time. The unfortunate thing is, the gov still approve this kind of lob sided contract even when the economy was hit badly.

The Samy Vellu ministry should take note and stop approve this kind of contract in future. The contract should protect consumers as well, especially the clauses on the toll rates. And should be allowed to restructure from time to time based on economy factor. And please practice transparency, so that no suprise for consumers, everyone knows from day one what are the rates in the contract. Keeping the contracts as top secrets only deteriorates citizens' trusts in the government.

Also, I don't think if you make the contract not so attractive, no one will invest and the country will not grow. When the economy is bad, a lot of competent company will be willing to queue up for the project. The country has to learn to do business the smart way if it wants to grow healthily. The kind of growth we are having now where the citizens' pain are made in exchange of the benefit of a few riches is not healthy at all.

Those legal contracts have been signed, not much to tweak actually. If we want to break it, legally the company should be compensated. The moneys have to come out. It is the proportion between the government (tax payers money) and the road users. Or extend the concession duration.

Samy said the gov is afraid the private sector will loose confidence in investing if the gov buy back the concessions (break the contract). No, Mr Samy you misunderstood, you don't have to force it through, all you need to do is make an offer to buy it at the price the gov think benefits both. The rakyat happy, gov happy, the concessionaire who are willing to sell also happy. ...I think I'm talking cock.

To solve this shit, for sure there is pain. It is how we disperse the pain... and we have to be realistic. To ask the gov to buy it back at no gain, I mean statistically, the department have to show it is worth the buying. I think the gov may consider if we allow the government to continue collecting tolls at a lower rates for say up to 10 years? I don't know, maybe a bad idea, just a suggestion.

Guess the 'katak dibawah rambut palsu'(as quoted by another blogger) has done it again - draining our pockets & we will have to keep voting such parasites back to power?

What's the difference with the looters if we NATIONALIZE these projects? You asked them to build something and you rob it away later.

To prevent one-sided agreements, daylight robberies or just simply protecting your rights and mere existence, no govt of the day should EVER be given a 2/3 majority. There should NOT be any carte blance to anyone to do what they pleases. Denying any govt of a 2/3 majority means having a good check and balance to prevent the unscrupulous from emptying the country's coffers.

We have only ourselves to blame for giving the 92% mandate to BN to carry out many of the useless projects like making teh tarik in space, England Sports Complex, etc. which are passed in parliment without problems and rammed down the raayat's throat. Although the contracts for the highway concessions might be from the Tun's era, nevertheless he too have had 2/3 majority - which means the right to do anything without any check and balance. We are still suffering the consequences up to date.

Please do the right thing and vote against the BN so that we do not have to suffer the consequences for the rest of ours and our children's lives.

Maybe it's not a good idea to have many parties grouped under BN or BA. BN can be viewed as a single party based on corruption and racism.

A stronger opposition voice is required. Present government should realise that in order to solve the problem of corruption and incompetency, the only way is to enforce true meritocracy in all levels and give the opposition a stronger voice.

But selfish people are too blinded by greed to see this.

MCA and MIC should consider breaking away from BN and form a new party. Politics based on race will never take this country to greater heights in this flat world.

Needless to say, "stargazer", I do not agree with your views.

But, you are entitled to your views.

Time will tell how right, or wrong, my views and yours are.
