Prejudice? Sub-judice?

Only those in the legal and media fraternities need reply.

Is this NST reporter, and the editor who cleared the copy, worms in the analyst's intestines? Is this framing up a person before a formal charge is read?

We thought that, apart from the murder, the key question people asked is how firearms and exclusive explosives, as reported in the media, were obtained and authorised to finish off a person's life by personnel from the police force?

Anyone who knows about the "jigsaw effect" that culminates in defamation, where individuals are identified by location or circumstance?

I've not had the inclination to plow through all the articles on this matter, but I was told the police don't have access to the kinds of explosives used? That kind of stuff is supposedly only made available to military and Dept. of Defence people? True ar?

Also, what else do we know about these 3 cops? Backgrounds, regular assignments, etc?...

I was very surprised that NST virtually confirmed that Razak Baginda was the killer.

Me thinks that something "stinks" here - more so I've never seen our local police solve a case so quickly.

Personally I think there is more than meets the eye.

So I will just read what NST and The Star "reported". Hand grenades or C4, Married or Not Married, Converted or Not Converted. So NST gives one version, The Star gives another. The "report" was also changing by the day.

To me there are others who have access to those 3 police officers - not just the said political analyst.

That tells me that (assuming, of course, that we are getting a factual account here) a middle aged man had a fling, got tired of it when she wanted more, refused to dump his wife or tell her, and then was not pleased when the spurned girl came to look for him. He asked for help from the police, and later he was not bothered anymore. You are reading a whole lot more into what was said. Your guess might be correct, but that's not what is said by the newspaper.

NO SUB-JUDICE YET

Now it is only trials by the media and blogs. The media and blogs may write the facts (and fictions)as they wish or fancy. Sub-judice does not arise here as the accused(s) are not yet formally charged ( or in the States, they are not indicted yet).

The suspects may of course seek redress in the form of defamation suit against those who allegedly defame....But in real life court drama this suit is extremely difficult to be proved because the news reported facts and the defences of "fair comment" and "public interest" are always available....

For eg., DSAI was at the end of the day acquitted of the sodomy charges. Is he prepared to sue the press which played up the stories outside the court proceedings? I don't think so.

He sued TDM finally because TDM repeated the allegations in a public forum.

But the media and blogs ought to be cautious : They may be summoned by the Court to explain the news reports or commentaries....

There cannot be contempt at this stage. So the media and blogs can always explain that the publication is in the public interest blah-blah.

But as truly professional , we must be fair and avoid inuendos and false stories.

Yes, he asked the police for help...But according to what was reported, when non seemed forthcoming, he sought the help of friends or connections who were from the police....Lets not disparage the police force!!!

Curiousity killed the cat, but the cat have nine lives. This is human nature, prejudice or sub judice or not, we are not going to influence our so called Police Diraja or the learned judge. Let us ponder and wonder at our own free wll. This is our right to free expression.

Generally, I concur with tehtarik's views.
I'm afraid to red at CERTAIN Blogs (not here at screnshots) where haadlines were writ in sensattional fashion on immediatele reading gives the reader an inference that a "paryticular" suspect wa the murderre involved. Disclaimer added as an afterthought in fact are just "mitigating" -- NOT legally-forgiving -- factors.
Some "commenters" also write with innuenndoes that a particular person was the "father" of the victim's child, adding mockery by passing comments that a particular suspect was the "perpetrator" and did exericise minimum responsibility by not using condoms to prevenyt a preganncy.

As tehtraik said, these could be grounds for later "suits for defamation", and he rightly cited Anwar' case about him only going after the ex-PM but not the prss (I remember the Malay Mail came out with a special edition reporting the then PM explicitly describing the sodomy acts which was clearly sub-judice!). I would urge fellow Bloggers to use state facts attributed to authorities like the police and not add their "opinions" like it's a CSI episode. Hey, this is NOT a television eposode from Hollywood.

questions tat i wanted to ask

- where can i get the C4 since it is so easily to be obtained? sure no 'nien sau' will come to me this CNY

- why does he get the special privilege to have his face n name being 'blocked' in the media? others oso suspect wat but still kena show face

- why every VIP suspect always 'masuk' hospital one?

- why the police can get them within few days after a police report by the embassy while our theft reports take weeks to settle and somemore, cannot solve?

- why everyone ask the mongolian consul to shut up? let him talk lah if the things he said is right

but then the c4 one, sure no one can give a good explanation one. tat guy is a political analyst and his wife is a judge, so flaw is our justice system will sure gets him out. but we just hope tat this girl will get her justice....

MALAYSIA BOLEH?! it's a sad day.........
