Review 1988 sacking of judges?

Bar Council president Yeo Yang Poh issued a statement two days ago calling for a thorough review of the 1988 sacking of the three judges, during the tenure of then Prime Minister Dr Mahathir Mohamad.

The three judges sacked for misconduct by a special tribunal set up by the then government were former Lord President Salleh Abas and Federal Court Judges George Seah and Wan Suleiman Pawanteh.

Describing the incident as the "darkest days for the Malaysian judiciary", Yeo said an impartial re-examination of the attack by the Executive then on the judiciary was necessary to restore the honour of the judges.

The Bar Council said the on-going criticism by Dr Mahathir against the current administration had rekindled discussions of the numerous deeds and misdeeds of the government under more than two decades of the previous leadership.

Let's see what the de facto law minister at today's PM's Office say. Undo past wrongs now? Or perpetuate the same old, same old workings of Executive presiding over Judiciary?

i think Nazri will support this review. Rais is too busy with the coliseum.

nazri may support, rais may support but someone need to send the message to aab directly. he might support. but if no one ask him directly, he may be blur-blur again...

Nazri, a minister whom many, including me, have hantam puas-puas and for good reasons, can actually surprise now and then with absolute gems of the real sort.

There are times when I am absolutely behind him and take my hat off to him.

So this may be a golden opportunity for him to put an indelible mark on Malaysian history, one which generations to come will speak of with respect and heartfelt gratitude.

Will he grasp the chance and spearhead the push for a review of the 1988 sacking of the 3 judges?

For everyone's sake, I hope he does. This is one battle in which he is ideally placed to be a 'warrior'.

For the sake of Negara kita, and every bangsa which makes up its rakyat, even for Nazri himself, I hope he does.

The Bar Council's call to reexamine the sacking of the judges is most appropriate and overdue.That episode must the most disgusting and most disgraceful of all the damaging "contribution" of our former PM of 22 years towards nation building! In the process, he destroyed the judiciary,the police force and Attorney General's chambers.It does not speak well of those who took orders blindly and meekly to destroy others, in this case the judges involved who did not do anything wrong so that one man could continue to be in power.It is a frightening thought that we had and have men lacking in courage within the judiciary,the police force and the attorney general's chambers, all of whom were and are sworn to protect the innocent and uphold the law without fear and favour! Some of those involved in that infamous event are dead but some are still alive and holding powerful positions.It is not comforting to the nation and its people.Isn't it?
This is the time for the present government to show that it has the backbone and the courage to heed the call of the Bar Council to reexamine the entire national shame so that the judiciary's name and the name of the judges may restored.

Why get so excited? The facts of the case were known then and criticism of it was needed then. Yet Mahathir was given full support to proceed with raping the judiciary. Fair enough, Rais and AAB did not lend their name then to the rape of the judiciary. But after leaving and getting to know later which side the bread was buttered they rejoined the rapist of the judiciary, did they not?

They also had so many opportunities, whether through UMNO Baru or through their Cabinet positions to call for a review...They maintained their elegant silence then.

O.k. let us chalk it all down to being a politician. Fine. What about the fourth estate then? Today, the mainstream media shamelessly refers to the period and the events employing the same terms used by the President of the Bar Council. At that time, they did their utmost to convince us all how right it was that the 5 judges deserved sacking and that the sanctity of the courts had to be maintained. And now they are going to write otherwise. And who was it that said that the mainstream media were the bastion of truth and honesty? Bullshit maybe. As for truth, I don't think they know the meaning of that word.

I suppose The Star can maintain a smug face this time as they were suspended at the time weren't they?

Any possibility from the new finding that UMNO Baru is illegal?

Talking about the judiciary and the laws of the land, may I ask a question about an article I read in yesterday's issue of TheSun. If someone was to topple the prime minister, doesn't that amount to treason? And what if someone who has the evidence of a plot to topple the prime minister but chooses to withhold that evidence, would that not make him guilty as well? To me, this is a very serious allegation and I would be very very surprised if the authorities have not acted upon these charges.

toppling the pm is not treason.
toppling the king is.
of course, that means absolutely nothing except that it is another law that the gov can use at its convenient to impose its will , to send a message, or whatever. anyone want to know/guess who is the last person charged with treason?

In any case I was highlighting the serious allegation more than the definition.

I laud and commend the act of correcting the wrong and misdeeds done by any politician... my only problem is 'why now?'... after all these years (16 years later and after 3 years since he stepped down) they ve never ever mentioned anything of this case... when mahathir is demanding answers (that never came) from the govt, now they want to push for a review?

blackrage, why now? you asked. you really don't know? why suddenly everyone starts to speak up? the ex-judges, ex-journos, the oppositions, the ngo's, even ministers and mp's? why now indeed. perhaps because while the current administration may seem to give you silence in response to questions, the previous one slapped you until you learned to shut up? why are we condemning people for not speaking up until now? do we really expect people to risk their skin to stand up against injustice? how many of us actually feel any gratitude towards people who lost their job or even detained, under isa, or osa, or illicit sexual activities, for speaking up? dr.m is a sly tactician. he is demonstrating the concept "the best defence is offence." let learn from the master.

The judiciary branch provides check-and-balance on the executive branch and must be reempowered.

We have seen how executive powers can swamp and create chaos for future generations in the absence of a mediating force in the background respected by all communities.

What happened during M2 days is being repeated in another form in this AB's time. Then it was by "force of hire and fire"; now it's "don't disturb sensitivities".

The result is the same - blockade of the rakyat's right to adjudication based on legal counsel that rides above executive branch considerations which, as has been noted, border more on communal agendas and personal limitations.

The question remains, if the judiciary is reempowered, who will in turn be its check-&-balance? This should be discussed and a workable model formulated.

lsk my man... dont get me wrong... as I said... I laud the move... its the right thing to do... thing is.. we have a bigger fish to fry... what AAB is doing to the country right now is putting all the rakyat under jeopardy... what AAB doing now will affect our immediate future...

I m just looking at this issue as a diversion of what Mahathir have raised...

resolve the problem that AAB and Sons created then we ll go for Mahathir...

The present Govt. should be left to carry on with its job of governing the country instead of being told to dig up old hogwash. The current president of the Bar Council may be having an axe to grind against Mahathir & hence he starts this rhetoric of 'justice'. Mahathir as the Head of State would have taken that decision in the best interest of our Nation. Guess the esteemed Mr. Yeoh should find something else better to do with his spare time instead of issuing statements. Then again, does Mr. Yeoh have a hidden political agenda???SHOOT me in my head if I am wrong!

Mahathir did not take that action in the best interest of the nation..it was in his interest. And if there is a way to bring some dignity back to the lives of those the Tun sacked unceremoniously..we shoud do it. Doing something right is not hog wash.
