P Gunasegaram says his life is threatened

Remember 1979, during the influx of the Vietnamese Boat People into Malaysia? Dr Mahathir, then not yet the prime minister, was vilified by the international media for saying "Shoot them!" when what he really meant was "to fix the refugees' problem". There is an Internet archive on this.

Twenty-seven years later, the same episode has befallen a Screenshots reader, thus implicating this weblog.

theSun (August 4, Pg 2) reports that theSun and Nexnews Group Executive Editor P. Gunasegaram yesterday lodged a complaint against this weblog for allegedly "carrying a posting inciting people to do bodily harm to Gunasegaram over an article he wrote".

  • Aug 3, 2006 11:14 AM: P Gunasegaram sent me an email, titled: 'Incitement to kill me'

    P Gunasegaram was referring to a comment by reader IImran who posted under the blog entry, titled: CATCH (Gunasegaram's) 22... ( 2 ) dated August 2.

    Gunasegaram referred to IImran's remarks and said: "'Shoot this Gunasegaram for good' means to kill him".

  • Aug 3, 2006 11:56 AM: I immediately forwarded Gunasegaram's email to llmran, in which I added: "Please give me your perspective before I reply."

    It is my wish that reader lImran must be given the benefit of all doubts, bearing in mind the remotest possibility that he might not be a wordsmith who writes for a living.

    It was also my impression that lImran's email on record, as captured by the TypeKey commenters authentication system, has verified lImran's email addresses to be bona fide. He should be able to come back to clarify.

    Meanwhile, the portions of lImran's comment, to which Gunasegaram deemed offensive, was immediated deleted.

    I was then cut-off from Internet for the rest of the day.

However, before I could relay reader llmran's clarification to P Gunasegaram, the journalist has decided to go to Press with his grievances. A private reply to his email has thus been pre-empted.

Now that reader Ilmran has stepped forward to clarify, I sincerely hope that he is given the benefits of doubts and his explanation accepted. Screenshots and its one-man blogger who has to work for his three square meals, apologise for not being able to stay glued to the computer 24/7 and make a total surveillence of the commenters' remarks around the clock. But let it be stated in no uncertain term that I shall endeavour to moderate whatever offensive remarks to the best of my ability, or upon alerts by the readers.

The right to dissent

I respect P Gunasegaram's right to persistently criticise former Prime Minister Dr Mahathir Mohamad -- not once, but twice in just these two months alone -- without giving an iota of sincere credit for his 22 years of service to the country, and we do not know know if he will continue to vilify Dr Mahathir incessantly the way he did. That's his right.

However, it's my contention that, in this Internet Era where information is empowered in the hands of the readers, the readers should be accorded their rights of dissent.

Meanwhile, this blogger will continue to exercise the highest level of vigilance in moderating the commentary section in a fair and responsible manner to all readers and its subject matters, and this has been the diligent practice for this blogger all along.

There is a distinction between a good blog and a bad one. And I quote a senior Malaysian journalist, who has since been blogging actively, on the limitation a blogging individual faces, and things that he/she can do to thwart parties who attempt to vilify bloggers generally in one bold stroke:

Malah dalam perang propaganda, laman web dan blog yang berwibawalah inilah yang lebih ditakuti kerana ia mampu mempengaruhi pendapat umum berbanding dengan laman web dan blog yang lucah, celupar dan penuh maki hamun.

While I am saddened that the quality of discourse has dropped so drastically in the mainstream press, It is my pledge that there will be more bloggers, like me, who will do our little part in upholding the dignity of the opinion space while adhering strictly to the prevailing laws in the country.

Non-violence

On the part of this blogger, I will have no part in advocating violence. I have blogged incessantly on Peace, and participated actively in Perdana Global Peace Forum activities. So, I don't have to repeat that violence has no place in this blog.

However, should Gunasegaram's relentless criticism of Dr Mahathir arouse any negative response from the populace at large, it's only fair that Gunasegaram should personally take the whole brunt of what he writes. Nobody can usurp the responsibility over your safety that you claimed to have been threatened. You, after all, are what you write.

I now present you what P. Gunasegaram wrote in his email to this blog. Please tell us if you agree with his talking-down, self-serving, and worse, coercive language.

For whatever agenda that is emerging, it's Gunasegaram who had wanted to shut me up.

Report lodged against internet website

PETALING JAYA: theSun and Nexnews Group Executive Editor P. Gunasegaram yesterday lodged a complaint against an internet website for carrying a posting inciting people to do bodily harm to Gunasegaram over an article he wrote.

The complaint was made to the Communications and Multimedia Content Forum of Malaysia (CMCF), an industry body set up under the Communications and Multimedia Act 1988 that is tasked with monitoring contents and handling complaints.

Gunasegaram had written an article "The Myth of Mahathir's Invincibility" that appeared in theSun on Wednesday. The website concerned had on the same day reproduced the article and solicited reaction. Several people responded and someone who identified himself as "IImran" suggested that Gunasegaram be shot for his views on Mahathir.

Nexnews Group Editor-in-Chief Ho Kay Tat said: "The website concerned is moderated by blogger Jeff Ooi who we hold responsible for allowing the posting `Somebody, please shoot this Gunasegaram for good' to appear on his website.

"While we have no problem having anyone debate, discuss or even challenge what Gunasegaram wrote and indeed many people have ­ threat of bodily harm is another thing altogether and should be taken seriously," said Ho. "It was irresponsible of Ooi to allow the posting on his website. We do not understand what motivated him to allow it."

Gunasegaram had yesterday morning also written to Ooi demanding that he remove the threat from his website. The posting, which was there for over 24 hours, was subsequently removed.

Ho said it was decided that a formal complaint to CMCF should still be made because there should be no repeat of such internet postings on that or any other website.

"The internet is not a lawless entity where people can do anything they want," he said. "It is still subject to the laws of the country."

He added that as a newspaper group, Nexnews supports freedom of speech and freedom of expression but a threat to hurt someone is criminal intimidation, not freedom of expression.

"Freedom of expression does not extend to inciting people to cause harm to someone else," Ho said. "Indeed, the threat to Gunasegaram was clearly meant to shut him up. Those of us who cherish freedom of expression should be abhorred that a website that claims to be a champion of free speech saw it fit to allow someone to make that threat."

1. Siti Nurhaliza is a God?

In my opinion, Limran did not really mean for people to go and shoot Guna.

If you take the word "shoot" alone, it can be inteprate as to be "to gun down" but if you look at the whole sentence and the situation (i.e., debating or discussion in blogs) the sentence is definitely mean "to take aim at Gunasegaram". Aim with what. of course with words since we are in blogs here and not in shooting gallery.

According to Webster dictionary, "Shoot for" mean "to aim at". So the sentence "SHOOT this Gunasegaram FOR good" can be inteprate as "to aim our comments permanently at Gunasegaram".

Shoot also means among others, fire, Letoff, Discharge,spurt,squirt,run,dart,race,zip,zoom,film,photograph.

I think if we googled on "Shoot" there will be thousands of meaning.

I suggest Mr.P.Gunasegaram while his editor in chief Mr. Ho should have Googled or Wiki the word "Shoot" before Jumping on their guns.

In another common way of speaking, when one permits the other party to say something, he might just use the simple word 'Shoot'.

As one simple example here, lest another misinterprete the message:

Tom: Dad, I've got something to say.

Dad: Shoot.

I still absolutely disagree with the fact that the blog owner can be held responsible for comments. Comments are the responsibility of the commenters, especially if they are registered commenters.
So this Gunasegaram should have filed a report against the commenter not Jeff Ooi!
Furthermore mr. Gunasegaram should not cry foul he could have expected to receive harsh comments on his one sited article. But of course he probably has the protection of the ruling group.

This is an open forum system, albeit a moderated one. Why should the moderator gets bitched at and complained at for his approach to moderation his forum?

I read Mr Guna's articles in the star and all of them make a lot of sense. But I have lost all respect for him and the weekly he writes for being so childish and unbecoming of a journalist, a very senior one at that I believe, who cannot laugh at the comment, like everybody else, he takes offence for. There is absolutely no malice in an off the cuff remark like that.These are the guys who talk about press freedom!
But wait a minute. Is this another step to the threats the govt. has been talking about detaining bloggers and is he and his weekly contributing what it can,lending a hand, to strengten the case against and currying favour?

Nope - it was Dr M. I remembered it caused an international uproar then. And he tried to wriggle out of this "shooting his mouth off" by claiming that he was misquoted by the press and he actually said "Shoo them", as in shoo-ing them away. How does one shoo away boat people?

It is absurd to assume the same rules outside the net applies here.

People empowered and secure behind their veil of anonymity on the net would be more bold in expressing opinions, considering they are less binding then statements out in the open. It's a whole different field.

Quite recently, when Mr.Wong made a brief mention on Dr.M 'anti-corrosion action', he was reprimanded ( I wanted to use 'almost lynched'...better play safe here). Today, another author wrote two volumes of not so nice 'fair commentaries' on Dr.M and he want to reprimand the public Joe for commenting on his articles. Why the sudden change in direction?

I recollect seeing a film on the historic meeting among Roosevelt,Stalin and Churchil asto how to contain and check Germany during the W.W 2. Either Roosevelt or Stalin suggested as a joke that the best 50000 German scientists be rounded up.Churchil asks then what?Roosevelt answers" Shoot them". Churchill was not amused because he did not realise it was a joke meant to upset him. The story is correct but I cannot exactly recollect the sequence.
Please learn to laugh, especially people in public life, like journalists,in particular when the joke in on us.

Oh sh*t.. (strictly speaking I might be breaking the law to swear in the public…), it sounds to me another sad case of an editor who had failed the English test if he chooses to in interpret the many meanings of the word "shoot" in such a narrow way.

But wait a minute, I had read many of his articles before and I think he is a Malaysian of very high caliber and standard. He is definite a good guy who I believe has a much bigger capacity and tolerance level to accommodate diverse views or ideas. What the fxck is a blog and the view expressed by a “kecik moyet” blog reader as compared to something written by a GEIC of a print media giant which commands much much wider readership, respect and not to say influence.

I think the size and the influence of “Citizen Jounalism” is not reaching a stage to threaten anybody’s job or “rice bowl” or position yet. Coming from a newspaper editor, I felt sorry for the journalist in our country.

In his article on Mahathir in theSun, Guna himself wrote in his last-but-one paragraph.... Our govt through their media proxy is very fond of building up issues in the mass media which controls public perception.

Build it up, pre-warn us before action is coming so when once the hatchet is swung, no one is caught by 'surprised'.

2. Don't waste water

- maybe after election.

Thank you for correcting me Jeff. If you haven't moderate the post then you cannot be held responsible. The responsibility is squarely with the person who posted the the comment. Anyway you did show transparency (yes, a word we heard everyday from the government but hardly practiced) and that is commendable. Everyone is entitled to explain themselves in a democratic country.

I am not lawyer, but I would like to share with you our Malaysia Penal Code Section 351 entitled "Assault" that says:

Whoever makes any gesture or any preparation, intending or knowing it to be likely that such gesture or preparation will cause any person present to apprehend that he who makes that gesture or preparation is about to use criminal force to that person, is said to commit an assault.

Explanation: Mere words do not amount to an assault. But the words which a person uses may give to his gestures or preparation such a meaning as may make those gestures or preparations amount to an assault.

Illustrations:

(a) 'A' shakes his fist at 'Z', intending or knowing it to be likely that he may thereby cause 'Z' to believe that he is about to strike 'Z', he has committed an assault.

(b) 'A' begins to unloose the muzzle of a ferocious dog, intending or knowing it to be likely that he may thereby cause 'Z' to believe that he is about to cause the dog to attack 'Z'. He has committed an assault upon 'Z'.

(c) 'A' takes up a stick, saying to 'Z', "I will give you a beating." Here, though the words used by 'A' could in no case amount to an assault, and though the mere gesture, unaccompanied by any other circumstances might not amount to an assault, the gesture explained by the words may amount to an assault.

More I read more angry I grow. here is a case of an almighty draconian with unseen Agenda intimating the net-citizen. Earler it seem [ DELETED ] guna is the victim, he claimed that his 2-sen worth of life has been thretened. When he made the complain n taking to press, he turned the table and become the BULLY.

He obviously thinks he can use his columns in The Edge to try and divert people's attention from the issues that is valid to address; believing in his self professed wisdom (what a joke if compared to what Tun M have done for the country, mistakes included).I am not sure what is his preoccupation not to agree with Tun Mahathir is all about-it does borders close to a personal dislike (that is his real problem actually ).Khairy and the PM and cabinet members have not answered the issues satisfactorily...so please just answer the question proper - we do not want to hear what Tun M should do, should not do or should have done.Just answer the guy and please dont insult the people's intelligence by giving lame answers..because all of you claim to be so wise that you lobbied be elected right?.Mr Guna, all your so called educated analysis will not change that fact.As for the 'shoot' issue, come on Mr Guna...your are a journalist are you not?
