Nexnews' stand on "gun" and "shoot"

My home Streamyx is still down! I am using Jaring dial-up to blog this entry, so I will be brief.

Senior editors of Nexnews Media Group told the Complaints Bureau of the Communications and Multimedia Content Forum yesterday the following:

1 ) The phrase: "And it is an open secret that unless you put a gun to the heads of many of those in power, nothing will move”

Nexnews argued that:

  • It is not seditious by legal definition in Malaysia

  • It is frivolous to even bring it up to the attention of the Complaints Bureau

  • "To put a gun to one's head" is an idiomatic expression commonly used is English

  • It has been taken out of context

Nexnews' stand on the above, the online version of the implicated article is available here, was conveyed by R. Nadeswaran, theSun deputy editor who represented its Group Editor-in-Chief Ho Kay Tat, Ho did not show up even though he was the named respondent in a public complaint to the Complaints Bureau (see briefs here), and the Bureau allowed it. Nadeswaran was accompanied by theSun editor Chong Cheng Hai.

Hearing on this issue was over within 10 minutes after theSun gave its stand.

2 ) The phrase "Shoot him for good"

Nexnews argued that:

  • The phrase "shoot him for good" was a threat to editor P.Gunasegaram's life though "threat issuer in Malaysia normally doesn't follow up with real action"

  • There must be a prominent, public apology by the blog owner over the cited reader's comment

  • There must be assurance that such words of threats, including all languanges deemed offensive by the law, including those defined in Section 2 of the Content Code, must not be repeated

  • Screenshots is singled out, in this case, because it is "the most influential blog" in Malaysia

  • P. Gunasegaram is ready to file subsequent complaints against Screenshots if needs be

Nexnews' stand on the above was articulated by its Group Executive Editor P. Gunasegaram.

Protracted volleys of view points were heard from both sides, the Chairman and the CMCF councilmembers, and unresolved key points will be dealt with next Tuesday, with the Complaints Bureau making no final decision.

Ths Complaints Bureau, however, has yet to make any decisions except to mediate. The mediation shall continue at 9.30am, August 29.

The mediation was chaired by Complaints Bureau chairman, Datuk Mohamed Bazain Idris, assisted by CMCF executive director Mohd Mustafa Fazil Mohd Abdan and executive secretary J. Matthews. As the legal provision for members constituting the Complaints Bureau CMCF is vague in the Complaints Bureau by-law, the Chairman has used his discretion to invites CMCF council members to comprise yesterday's sitting. The Complaints Bureau by-law itself will only become effective from September 12, 2006.

There were three CMCF council members, representing the industry from TM Net(Dr Fadhlullah Suhaimi Abdul Malek), TV3 (Laili Hanim Mahmood) and Axis-Films (Paul Loosley), who attended the meeting yesterday.

There was no representation from the Civil Society group among the CMCF council members.

It is noted that the Content Code is a guideline for self-regulation in the online content industry. Compliance is voluntary to the Code Subjects, who are either individual or class licenses under the Communications and Multimedia Act 1998, of which blogs are not licensees.

Mainstream Media vs. Blog

The mediation came about P. Gunasegaram had filed a complaint against a reader's comment posted on this blog, claiming that his life was threatened (see blog entries here). Prior to this, he has repeatedly criticised Dr Mahathir's track records in the former Prime Minister's 22-year administration, including interfering of the judiciary and perpetuating patronage and cronyism, which has aroused critical responses from several blog readers.

August 4, Ho in his capacity as the Group Editor-in-Chief of Nexnews Media Group, which publishes The Edge and theSun, said "as a newspaper group, Nexnews supports freedom of speech and freedom of expression but a threat to hurt someone is criminal intimidation, not freedom of expression.

"Freedom of expression does not extend to inciting people to cause harm to someone else," Ho said. "Indeed, the threat to Gunasegaram was clearly meant to shut him up. Those of us who cherish freedom of expression should be abhorred that a website that claims to be a champion of free speech saw it fit to allow someone to make that threat," Ho said.

Nexnews is majority-owned by Canada-based Tong Kooi Ong and construction/gaming tycoon Vincent Tan.

how isn't this [ DELETED ] case frivolous to bring this up to the CMCF attention can somebody shed some light here?

Both references under "hearing" were each -- borrowing nexnews' words -- "is an idiomatic expression commonly used is English".

It's much ado about nothing -- so Ilmran and Commenters' are assured by Jeff's words -- don't lose sleep over this case.

My parting shot to Nexnews Ho, Guna and Nades -- What's good for the goose is good for the gander. Don't gun for Desi, okay! ~~ I'm merely using another English adage.

I'm sure Nexnews bunch wont back down on this complaint, and Jeff has no reason to bow down to them either.

We'll definitely see more fireworks in the coming days.

Just because The Sun chooses to interprete something the way that is most convenient to them it ddoes not mean it ought to be universally accepted. Maintaining their present stand only seems to suggest motive for mischief making. And that is all that this storm in a tea cup is.

As easily as they choose to interprete the "shoot" statement to suggest a personal threat, so can anyone who may not be an english expert to take the "Gun to the head" to mean nothing but just that and to act on it. Considering The Sun is given away free, that paper coould fall in the hands on some of out politicians or other innocent citizens whose language skills could be wanting. They could take that statement literally and "choose" to act on it. You have to remember in boleh land anything can happen. Considering The Sun is freely available to all and sundry on the street including very impressionable people, the onus is on them to avoid such suggestive statements which can easily be acted on. They hae to remember that that statement could appear anytime in the next few years as a wrapping in a fish market and be read by the most unlikely of people and acted on. That dangerous suggestion still stands.

In the case of screenshots, at least you can be sure only a few will accesss the internet and even fewer who will access Screenshots. If that "shoot" statement is considered to be a threat, it may have been for a short time. But if that "threat" stands as continuing, only The Sun and Gunasegaran stand to be blamed as they are the ones who have chosen to have that statement published in print. Furthermore, that statement was issued by one who is not a wordsmith and obviously cannot claim any expertise in the use or misuse of the English language unlike Nadeswaran and Gunasegaran.

for making a mountain out of a molehill I can only say that Gunasegaran is making an idiot of himself. Oh Gunasegaran, just in case you don't like that word assigned to you, I just want to tell you that from where I stand, my view of the situation reveals an idiotic situation and the person causing it looks like an idiot.

Is there a stronger word to IDIOT? Because now their readership will fall like SHOOTing stars and readership for Jeffooi.com will fly up like a rocket.

Why MCMC complain bureau accept some idiocrisy act in the 1st place?

I'm actually quite interested to hear Jeff's stance on theSun, wether he will still be promoting/advocating/supporting/[insert word here] theSun in his blog like he used to. He's been pretty quiet about that, heheh.

although with all of these free publicities (that theSun is trying to get) you do get free bad-quality toilet paper rolls or alas buntut during picnics or alas nasi lemak everywhere around Malaysia, so great for the little people!


but seriously, the only way to hate or take action or vote against theSun is simply to ignore them, both in this blog and around their newsstands.

If he really feels threatened, has he increased his security in the past few days?

If he really feels threatened, does he honestly think an apology would quell the threat? (By the blogger no less, and not the commenter).

Are their idionmatic expressions any more valid than the commenter's "shoot him down" expressions, whose context was subsequently explained? (whereas they never explained his idiomatic context. Hence it's still fair to take them putting the guns to everybody's head literally).

The case is full of holes. You rightfully should not lose any sleep over it.

Guna should just quit and let real men like Nades and Jeff continue their quest for justice for everyday Malaysians. i hope by not including Guna in my list of real men, i'm not getting Jeff into more dung. I don't care if they work in the same building or not, but give me a Nades article or a Jeff blog piece over Guna's whinging any day. enough of this sucking up business la. it's doing nothing for my country. i'd love to use stronger language, but people like Guna encourage silence and curtail creativity of Malaysians. it's goons like that who aspire to continue the non participation of Malaysians in healthy discussions. lagi ramai pak angguk, lagi bagus. betul ka? i'm guessing the ideal scenario for these people would be for no one to read Jeff's blog and no one to say what they think. suma dok diam-diam bawah tempurung.. dapat?

There are all kinda folks out there. P. Gunasegeram is merely another who's yearning for the attention which he lacks. But then again, shouldn't he really be living life on a low profile basis these days, because he really believes now that there is someone out there who wants to blow him to smithereens just because the would-be prepetrator has been instigated to do so by one of the blog commentators here? Aiyo, P. Gunasegeram, you and your bunch of merry men from Nexus really needs to grow up. Whatever you write is the gospel truth and are mere idioms of the English language, whereas what others write is not and meant to cause you physical harm. Talk about double standards at its most blatant. You guys are ripe for the circus. BTW that last statement is merely figure of speech too. So please don't come after me when those bozos from the Ringling Brothers come a-calling at your residence wanting you to work for them, ok? I cannot believe that there are so many clowns amongst us in Malaysian society.

if you were to chose to give it such an possible meaning, both statements are equally inciting ...
