Resistant and fighting back

Flashback to what the IGP, the Deputy IGP and Police Chiefs in various states had said several days prior to the bald-shave incident, you see the chain of command at work.

  • Via Utusan (Jan 28): KL Police Chief Mustafa Abdullah said the Police will no longer exercise their discretion and will stick to the book as many parties are on a fault-finding mission by putting the Police under tight scrutiny.

  • Via Utusan (Jan 29): Deputy IGP Musa Hassan said the Police will not remain silent towards any recommendations that are problematic and impossible to implement.

  • Via Utusan (Jan 29): Perak Police Chief Zainal Mohd. Tahir, Terengganu Police Chief Hussin Ismail , Selangor Police Chief Yahya Udin. Kedah Police Chief Zuber Shariff, Pahang Police Chief Ramli Yusuf and Johor Police Chief Mohd. Amir Sulaiman echoed Musa's view vehemently.

  • Via The NST (Jan 29): Inspector-General of Police Mohd Bakri Omar said his KL Police Chief, Mustafa Abdullah, was merely reminding his men to do what they were sworn to do and denied that the latter's statement was made out of frustration over the recent scrutiny and censure of the police force.

It gives you the impression that the Police are not resistant to the recommendations made by the Royal Commission. The chain of command indicates otherwise. They are fighting back.

You need to answer one question, though: Who are the Police up against?

Three questions from the folks who were shaven bald:

1 ) Is it lawful for Police to bald-shave people's heads during detention?
2 ) Is it wrong to gather for a game of mahjong during Chinese New Year?
3 ) Is it right to treat countryfolks, the oldest being 69, like hardcore criminals?

What the Police say:

  • Via The Star (Feb 3): Kajang OCPD Asst Comm Mohd Noor Hakim said it was normal lock-up procedure to shave a detainee's head. “We were just following the lock-up rules which states that “rambut mesti di potong pendek-pendek” (hair must be cut short), ACP Mohd Noor said adding that police would continue with this procedure.

  • Via The NST (Feb 3): Kajang CID chief Deputy Superintendent Abdul Fatah Ahmad said shaving the heads of detainees was a normal procedure. "We just want them to look neat and remember, it is so that they will not return to the lock-up," he said.

  • Via The NST (Feb 4): Selangor police chief Yahaya Udin said that cutting the hair of detainees is a mandatory procedure under Section 9A of the Lock-Up Rules 1953. "The section provides for people detained in lock-ups to have their heads shaved but not to make them bald. We cut their hair as short as possible and sporting short hair reflects positive image," he said, adding that the rule aimed to discipline offenders while in police detention.

What the 'Usual Suspects' say:

  • Via The NST (Feb 4): Human Rights Commissioner Prof Hamdan Adnan said: "What was done by the police on the men was improper. Even though shaving of the detainees’ heads is provided by the Lock-Up Rules, it’s allowed if the person detained has a skin disease on the head like kurap or has lice."

  • Via The NST (Feb 4): Bar Council president Yeo Yang Poh wondered whether there was a "teach you a lesson" element in this episode by police personnel, angered by the scrutiny they were receiving from the public.

  • Via The NST (Feb 4): Ramon Navaratnam, chairman of Asli Centre for Public Policy Studies, said: "This has been an act of gross insensitivity, it shows the police have lost touch with the pulse of the public."

  • Via The NST (Feb 4): N. Siva Subramaniam, a commissioner for Suhakam, the human rights watchdog, said: "One of the basic tenets of human rights is to treat everyone with dignity, and these actions by the police should not be condoned." He said the Polis Mesra (Friendly Police) tagline is indeed in tatters after such a display of heavy handed policing by these officers.

  • Via The NST (Feb 4): K. Shan, co-ordinator of National Human Rights Society (Hakam) said: "This is a clear case of harassment, the Federal Constitution states that no individual is to be denied of his personal liberties during detainment and this includes the shaving of hair."

  • Via The Star (Feb 4): Opposition Leader and MP for Ipoh Timur Lim Kit Siang said the action was high-handed and insensitive to human dignity and the rights of Malaysians. Lim said that such deliberate humiliation was deplorable when the police had just announced that OCPDs would be attending a human rights seminar soon.

Criminal lawyers interviewed by the New Straits Times said some of their clients who had been detained longer than the 11 men did not have their heads shaved.

Disgraceful and shameful - but surely just another indication of the times that we are now living in. What next ? Vigilantes ?

Perhaps to instill discipline amongst the police they shld get their heads shaven instead. If we get dropouts to become police this is what we get.

Dont forget we now need to pay for security guard services in our own neighbourhood to protect us as the police are not capable of. Later we need more of these svc to protect us from them.

Surely, if the lock-up rules say “rambut mesti di potong pendek-pendek”, why have they substituted botak-botak?

one thing I know.... Mahjong is a good activity for elderly. It can help prevent dementia by keeping your brain active. Definitely better than sitting infront of the tube sucking in passive entertainment.

The question to ask is if the shaving of heads constitutes a punishment?

In this case, it is obvious there was no need for any kind of body search or interrogation as all the suspects were presumably caught red handed and they probably were also not denying that they were gambling. In which case no effort needed to be put to obtain any kind of statement from any one of them. The information that the police needed from these suspects did not need an interrogation and coersion of any kind was also not needed.

Following procedure cannnot be supported because we all know that not all suspects who leave poplice detention or are brought to be charged in a court of law are bald headed or recently made bald.

Even if it is, can the fucking culprits responsible for this balding exercise show me where in the fucking law he finds the authority to institute punishment or for that matter gain his authority from to institute such procedure?

Failing to go after rapists and murderers, they're now going after harmless old men.

The PDRM must re-align its priorities and focus. When resources are unequal to situational demands, deploy them better where they can save lives, not mock Malaysia's already ungainly steps to modernization.

More beats in places of prowlers, more commanding presence where it counts, less beating around the bush on non-issues.

Do that and the rakyats' support will return. Do otherwise and the label sticks.

This is a disgrace! They are senior citizens lah for crying out loud!!! I tend to believe that the kopitiam owner must have forgotten to drop the Ang Pows at Kajang PD hence got this punishment.

A thought just came to me. What happened had one of the senior citizens suddenly collapse and died of a heart failure (the oldest one being 69 years). Can we sue the police for culpable homicide?

since when our judiciary system practice guilty until prove innocent? Maybe we should shave off the police hair for their insensitivity and not respecting civilian rights?This is totally bullshit!

I wonder - was the son of the IGP also given a short-haircut when he wa tahan for alledged selling of Pasar Ramadan permits?

Ditto for assorted well-connected people who kena tahan for a range of reasons? If not, WHY NOT?

I have been getting some rather unsettling vibes of late.

Like when the police declaring they will not be entertaining any explanation from those they are about to summon. Cracking the whip? Show of force?

Like when 3 associations which represent more than 2/3 of the force reject the proposal for the Independent Police Complaints and Misconduct Commission to be set up. Who are they to say no when there have been such overwhelming grounds which simply beg for such a commission to gosok bersih the thick layers of dirt revealed in the Royal Commission report (and elsewhere in recent events)? If they (the 3 assocaitions) say the presetn 4 commissions already tasked with monitoring the police is "more than adequate", then can they answer why such incidents like the shaving case still recur?

Memang memalukan if yet another watchdog is put in place to watch over the police, but face the truth. The dirt, the rot, the cancer is more massive than many can grasp. But the members of the three associations should know better than the public just how good, and just how bad, the force is now. And just how desperate the need for real reform is.

DO they want a cure, or do they want to cover-up and pretend everything is fine? And have more nude-squats and botak cases?


A failing law enforcement body, loosing rapidly the respect amd trust of the populace they are sworn to protect.

A failing education system and evidenced by the multi-billion Ringgit tuition industry.

Symptoms of a potentially failing state.

So where do we go from here? In many countries, this will be grounds for resignation of the relevant political leaders, and even regime change.

Here, we have more ostrich syndrome: everything okay, onto to the next scandal.

There can be no accountability without retribution.

this is tit for tat.So you guys just look out. If you are no one(read IGP son), you will be treated by the book, off course pendek pendek becomes botak. The police are out to get the ordinary people, isn't that the message while thieves roam or streets with fear of police. But the rakyat needs to fear the police cos they are going to throw the book at us.

Not sure which school the ocpd of kajang when to but pendek pendek is not botak. Guess Kajang police officers BM must be bad,well quality must be bad there. Gives Mesra Rakyat a new meaning.

It really smacks of retaliation. In "squatgate", the police used an unwritten procedure and got creamed. So now, they follow strictly a written procedure.

However, I think the police got it wrong. It surely cannot apply to people who can make bail or offences that are bailable. It should only apply to people who cannot make bail and have to be detained for an extended period or for non-bailable offences.

This Kajang OCPD Asst Comm Mohd Noor Hakim said they are merely complying with the normal lock-up procedure. But NST 4/1/06 reported 6 detainees whose heads were not shaved (Elie Najem Youssef, Kenneth Lee, Koh Kim Teck, Hanif Basree, To'ki and Ahmad Najib). Does this means other OCPD is not complying with the so-called normal procedure? Will this Kajang OCPD lodge a police report *sic* to apprehend the other OCPD for non-compliance and shave their heads botak-botak when under his detention in Kajang police station?
Sometimes, minor offences should be best handled with discretion, but sometimes in history, there'll emerge some people who can't use their head to think, thus created unnecessary public uproar. Pls give our PM some break, he really don't need such a childish vendetta to bug him when the global nude squat issue had barely laid low.

If indeed the recent antics of the police are in retaliation for the various actions being taken against the force for its misdeed, then what is Pak Lah going to do about it?

What does that "hero" of the police for Mohd Nor have to say now? Why not a peep from him when more and more of such "show of force" take place? And against Malaysians too so is he going to tell them to "balik, balik" if they do not like it?

Like a broken record, the joke which made the rounds during the nude squat episode keeps playing in my head:

It is because we have passionate but stupid superiors defending the indefensible position of their subordinates in the so called spirit of camaradarie that we have a bushy Lebanese and half a dozen of senior botak.

Why need courts anymore if the police are both prosecutor and judge ?

The action to shave the heads of the 11 senior citizens bald on this festive season leaves very much to be desired. Hardly a week goes by without such similar incident involving the Police. The police is law unto itself. Are we moving towards a Police state where we have the open defiance of the civil authorities entrusted by the people through the democrative process. Such utterances of the senior police officers of the force off late speak for itself. Where is the discipline and the obeyance of the civil authority entrusted by the people. A stop must be made right now lest it spiral on and out of control. We can discern elements of open defiance. There goes the days where the police force is treated as friends of the people. I remember in the early sixities of the last century, the police wore a badge depicting a 'handshake' as part of PR exercise to be friends of the people. The police is there to protect the people and not to redicule the people. Balding the heads is a police procedure so it says. But the question is whether the same applies to all under remand by the police for acts or actions to be determined whether harmful to civil society. There have been numerous personalities involved in criminal acts who are persons of 'status' but allowed to keep their 'locks'. For the Chinese, it is considered 'patang' to have the heads shaved bald during the most auspicious festive season - Chinese New Year. There must be sensitivity on such occasion lest the police be accused of discrimination!

I remember reading the press that playing mahjong is alright if the number of tables do not go more than 2. Again, different areas have different rulings. Whatever it is, there is definitely a need to look into police procedure. Set up police commission is no avail if there is open defiance. The situation must not be allowed to deteriorate further. Civil authority must rank supreme over uniform forces!

Firstly, the PDRM including IGB and OCPD is made of people with very low IQ.
Secondly, this will teach non muslims not to vote for BN/MCA. Rightly, MCA shld demand the resignation of the Kajang OCPD & its officers. But what did MCA say - an isolation and dont blow out of proportion. What a condescending attitude. Thks.

Forcing us to a very tight corner. Might be fun to live in malaysia right now but when it turns to something like indonesia or worse, iraq , bald head is just least of our worries.

PDRM wants to show power ?

Aiya... PDRM should offer the free shave b4 CNY then we can all save some hard earned money for better Mah Jong session during the 15 day CNY period.

I remember my drill sargeant telling me, DON'T FOLLOW LIKE BUFFALO , rules are there as a guideline, use discretion. The Royal Commission has definately BACKFIRED. The COPS are now on the rampage ! Pak lah , you have a choice of two things to do,either Buck them up or change PDRM (POLIS DI RAJA MALAYSIA)to PRDM (POLIS RAJA DI MALAYSIA )

Hi guys what Harry wrote is spot on !Don't try to read too much into the police 'hitting 'back after sqautgate !They aren't that smart its just that they had expected a Malaysian Batman that goes "Ang.....Pow !" whenever they call on you during the CNY period!

The malaise within the police force did not start yesterday. It started more than 20 years ago, when the police was changed to be subservient to the politicians. All that was done was for the politicians to "bribe" a few top brass, by extending their services, even after retirement age, and accelerated promotions, and from then on, the whole force had to fall in line and was at the behest of the politicians. They did what they were told to do, like spying on opposition parties, arresting opposition party leaders, breaking up peaceful demonstrations etc.
It is sad, that, what used to be an institution that was very highly regarded by the populace, was reduced to such a pathetic situation.
Like a person, they lost all their self respect, integrity and independence. Their self confidence eroded, they now can hardly talk back, and instead, compromised their principles and professionalism.
My belief is that the force is not made up of bad people, but it is a situation of good people being subject to a very bad system.
It will be an uphill battle for Pak Lah, who himself was part of the "sytem", being in the cabinet under Dr M, who has to take sole responsibility for this tragedy.

I think the top brass should stay. Why? Maybe they had crossed some lines during their tenure, but no one is perfect. I'm sure they had contributed considerably to reach their position.

M'sia need these old school because they know the climate of our country, sensitive to political expectations, truthful in their crime bustering.

Those that should resign are low level staffs like the Kajang OCPD who already use their might to to make revenge on the rakyat.

PDRM, we need you. Lets get things back in line. We willing to give you a chance, if you also willing to take this chance to better PDRM's image. Mesra.

its been barely a month since the naked squat incident, and now this. seems to me that they're trying to prove some point, but i just cant pinpoint what it is. it is indeed unnecessary, disrespectful, arbitrary and stupid. this would most likely further damage the reputation of malaysian police.
